Public Works Act 1981

Notice of Intention to Take an Interest in Land at Matangi (Part Lot 2 on D.P. 31605, Block IV, Hamilton Survey District) for a Right of Way Easement

Notice is hereby given that the Waikato County Council, under the provisions of the Public Works Act 1981, intends to take the interest in land described in the Schedule hereto for a right of way, to be used to provide access to an effluent treatment plant, such plant being shown as area “A” on Plan S.O. 57320.

The taking is considered essential for the operation of the effluent treatment plant.

Any person having an estate or interest in the land may within 20 working days after the date of this notice send an objection to the Registrar, Planning Tribunal, Tribunals Division, Justice Department, Private Bag, Wellington. If any objection is made in accordance with this notice, a public hearing will be held, unless the objector otherwise requires, and each objector will be informed of the time and place of the hearing.

Schedule

South Auckland Land District

A right of way easement over all that piece of land containing 2745 square metres, being Area B and on Plan S.O. 57320 and being part Lot 2 on D.P. 31605, Block IV, Hamilton Survey District and being part of the land comprised and described in certificate of title 1703/50, South Auckland Registry. Plan S.O. 57320 is lodged in the office of the Chief Surveyor at Hamilton.

A copy of the plan may also be seen at the Matangi General Store, Tauwhare Road, and at the offices of the Waikato County Council, 1 Clyde Street, Hamilton East.

The interest in land to be taken is part of the land known as Robinson’s Lane, situated on Tauwhare Road near the corner of Matangi Road.
