Notice of Appointment of Receiver

Pursuant to Section 346 (1) of the Companies Act 1955

The National Bank of New Zealand Ltd. with reference to Turbo Products Ltd. hereby gives notice that on the 2nd day of June 1989, the bank appointed Kevin Reginald Lewis, Maurice Kemble Twomey, Chartered Accountants, Coopers & Lybrand, Seventh Floor, CML Centre, 157 Queen Street, Auckland, jointly and severally as receivers and managers of the property of this company under the powers contained in an instrument dated the 11th day of May 1988. The receivers and managers have been appointed in respect of all the company’s undertaking and all its real and personal property and all its assets and effects, whatsoever and wheresoever, both present and future, including its uncalled and unpaid capital.

Notice of Appointment of Receivers and Managers

Moller Johnson Finance Ltd., being the holder of a debenture in its favour bearing date the 25th day of March 1988 and registered at the Companies Office at Wellington on the 21st day of April 1988 issued by Mahina Holdings Ltd. (“the company”) hereby gives notice that on the 2nd day of June 1989 under the powers contained in the said debenture it appointed Tolmie Alexander Scoular of Wellington, chartered accountant, as receiver and manager of all the undertaking property and assets of the company. The office of the said receiver and manager is at the offices of Coopers and Lybrand, UDC Tower, 113–119 The Terrace, Wellington.

Land Transfer Act Notices

By application B. 967319, I have been requested, pursuant to section 121 of the Land Transfer Act 1952, to register a notification of re-entry of lease by the Whangarei County Council, the lessor under memorandum of lease B. 470502.1 of all that parcel of land containing 1597 square metres, more or less, being Lot 8, Deposited Plan 103329 and being part of Section 37, Block VII, Ruakaka Survey District, comprised and described in certificate of title 56D/1353 (North Auckland Registry) of which Bream Bay Auto Spares Ltd. is the registered lessee, proof of the re-entry and recovery of possession of the land having been presented to me, I hereby give notice of my intention to register the aforesaid notification of re-entry upon the Register and upon the outstanding instruments of title at the expiration of 1 month from the date of publication of this notice in the New Zealand Gazette.

By application B. 984420, I have been requested pursuant to section 121 of the Land Transfer Act 1952, to register a notification of re-entry of lease by Jeanette Rosemary Crossley, research scientist, Donald Jeffrey Waugh Burns, research scientist and Helen Kathleen Waugh Burns, computer consultant, the lessors under memorandum of lease B. 384345.1 of the following parcels of land: (a) containing 1393 square metres, more or less, being Lot 1, Deposited Plan 89391 and being part Fairburns Old Land Claim 269A comprised in certificate of title 46B/944 (North Auckland Registry); (b) containing 690 square metres, more or less, being Lot 3, Deposited Plan 38074 and being part Fairburns Old Land Claim 269A comprised in certificate of title 29A/518 (North Auckland Registry) and also by the above-named as the lessors under memorandum of lease B. 384345.2 of that parcel of land: (c) containing 761 square metres, more or less, being Lot 2, Deposited Plan 38074 and being part Fairburns Old Land Claim 269A comprised in certificate of title 56A/670 (North Auckland Registry) of which Alpha Properties Ltd. is the registered lessee, proof of the re-entry and recovery of possession of land having been presented to me, I hereby give notice of my intention to register the aforesaid notification of re-entry upon the Register and upon the outstanding instruments of title at the expiration of 1 month from the date of publication of this notice in the New Zealand Gazette.

Coopers Holdings Ltd. is the registered lessee of both of the above leases, and proof of the re-entry and recovery of possession of land has been presented to me.
