Amending a Notice Declaring Land to be Crown Land in the Borough of Blenheim

Pursuant to section 55 of the Public Works Act 1981, the Minister of Lands hereby amends the notice dated the 21st day of August 1987 and published in the New Zealand Gazette of 27 August 1987, No. 145 at page 4061, declaring land to be Crown land in the Borough of Blenheim by omitting the Schedule and substituting the following:

An Easement Over Land Acquired for Soil Conservation and River Control Purposes in Block III, Te Mata Survey District, Hawke’s Bay County

Pursuant to section 20 of the Public Works Act 1981, the Minister of Lands declares that, an agreement to that effect having been entered into, the following easement to gross is acquired for soil conservation and river control purposes (and may be surrendered at any time by notice in the Gazette) vesting in The Hawke’s Bay Catchment Board (called the grantee) on the 9th day of June 1988, the right to drain water through an open drain constructed in accordance with the grantee’s construction plan No. 2014 including the full and free right in perpetuity for the grantee and its agents to do the following over the land described in the Schedule (called the land):

(a) To enter the land and pass and repass at all times with or without machinery or vehicles;

(b) To modify, maintain or reconstruct the drain and to do all things necessary to maintain the same in an efficient state;

(c) To prohibit the erection of any structure on or over the drain without the prior consent of the grantee;

(d) To exercise the within rights in a manner reasonably necessary to serve the purpose of the work.

Pursuant to sections 20 and 153 of the Public Works Act 1981, the Minister of Lands declares that, an agreement to that effect having been entered into, the land described in the Schedule hereto is hereby acquired for a limited access road which has become road, limited access road and State highway and shall vest in the Crown on the 9th day of June 1988.

Road Realignment and Road to be Stopped and Amalgamated in the District of Dannevirke

Pursuant to Part VIII of the Public Works Act 1981, the Minister of Lands:

(a) Pursuant to section 114, declares the land described in the First Schedule hereto to be road, and vested in the Dannevirke District Council.

(b) Pursuant to sections 116 and 117, declares the parts of road described in the Second Schedule hereto to be stopped, and declares that—

The area marked ‘C’ (now known as Section 78, Blk IX, Takapau S.D.) shall be amalgamated with the land in certificate of title D2/1459 subject to the mortgage 245689.
