Decision

These publications were imported by Waverly Publications in Auckland in or about December 1986. The publications were released in error by Customs and subsequently sold to Progressive Mail Order in Hamilton, and that company responsibly requested that they be submitted to the Tribunal for decision and classification. A seizure notice was accordingly issued by the Comptroller of Customs on 11 February 1987 and the books submitted to the Tribunal for classification and decision. In decision No. 24/87 issued on 16 December 1987 the Tribunal said:

"Other issues of Knave and Fiesta were previously considered by the Tribunal, and were the subject of a decision which went to appeal before the full Court of the High Court in Wellington. The full Court in its decision referred the publications back to the Tribunal for further consideration, and a date for the hearing of that matter has yet to be determined with counsel for the publishers. Prior to the Tribunal hearing on 11 September 1987 application was made by the New Zealand solicitors for the English publishers and the New Zealand importers and distributors that the hearing in respect of these particular publications should be deferred and be heard conjointly with the publications which were referred back to the Tribunal by the full Court. The Tribunal accepts that it would be pointless to deal with these particular publications separate from the other publications, and accordingly the decision on these matters is deferred until the further hearing of the Tribunal."

In a decision issued contemporaneously with this decision the Tribunal has classified other issues of Knave and Fiesta as indecent in the hands of persons under the age of 18 years and has in addition made a serial order in terms of section 15A of the Indecent Publications Act 1963.

The Tribunal is unanimous in its finding that these particular publications would be injurious to younger readers and accordingly classifies each as indecent in the hands of persons under the age of 18 years. The Tribunal also makes a serial order in terms of section 15A of the Indecent Publications Act 1963 in respect of the publications Knave and Fiesta.

International Air Services Licensing Act 1947

Notice of Intention to Amend an International Air Service Licence

Notice is hereby given that I intend to exercise the power conferred on me by section 14 of the International Air Services Licensing Act 1947 to amend the terms of the International Air Service Licence issued to Air Caledonie International to permit the airline to operate such additional scheduled services as may from time to time be approved by the Secretary for Transport, subject to any conditions which the Minister of Civil Aviation and Meteorological Services may impose in respect of those additional services.

This amendment will take effect on the 19th day of August 1988.
