The Comptroller of Customs, through Mr Wotherspoon, invited the Tribunal to give a serial restriction order under section 15A of the Indecent Publications Act, but the Tribunal is not prepared at this stage to make such an order.

Before the Indecent Publications Tribunal
In the matter of the Indecent Publications Act 1963, and in the matter of an application by the Comptroller of Customs for a decision in respect of the following publications: Roue No. 37, 39, 40, 41, 42, 43, 44, 45; Roue Correspondence Special: Janus, Vol. 5, No. 6, 12, Vol. 6, No. 2, 6, Vol. 8, No. 6; Derriere No. 1; New Janus No. 7.

Chairman: Judge R. R. Kearney.
Members: H. B. Dick, R. Barrington, A. J. Graham and K. A. R. Hulme.

Hearing at Wellington on the 11th day of September 1987.

Appearances: M. J. Wotherspoon for Comptroller of Customs. No appearance on behalf of importer.

Decision
These publications were commercially imported by mail at Hamilton and seized by the Collector of Customs at Hamilton. The importer has subsequently disputed forfeiture and the publications have been referred to the Tribunal for classification and decision prior to the commencement and condemnation proceedings pursuant to the Customs Act 1966.

These publications, which are in the magazine format, contain a mixture of photographs and text. The common theme of these publications is one of corporal punishment with an emphasis on the caning and spanking of school girls. A similar publication came before the Tribunal in Decision 12/86 of 13 November 1986, when the Tribunal considered the publication in question, Victorian Erotica, Volume 1, No. 1. Spanking Special, to be unconditionally indecent as containing the element of violence against females and particularly young females.

For exactly the same reasons are expressed in Decision 12/86 the Tribunal is unanimous that these publications are injurious to the public good and classifies each as unconditionally indecent.

District Courts Act 1947

Acting District Court Judge Appointed

Pursuant to section 10 of the District Courts Act 1947 and section 21 of the Children and Young Persons Act 1974, His Excellency the Governor-General has been pleased to appoint

David Anthony Ongley, barrister and solicitor of Palmerston North

to be an acting District Court Judge, to exercise civil and criminal jurisdiction in New Zealand and the jurisdiction of the Children and Young Persons Court for a term of 12 months on and from 28 March 1988.
