Notice is hereby given that a petition for the winding up of the above-named company by the High Court was, on the 20th day of April 1988, presented to the said Court by Shift Products (H.B.) Limited; and that the said petition is directed to be heard before the Court sitting at Hamilton on the 13th day of June 1988 at 10 o’clock in the forenoon; and any creditor or contributory of the said company desirous to support or oppose the making of an order on the said petition may appear at the time of hearing in person or by his counsel for that purpose; and a copy of the petition will be furnished by the undersigned to any creditor or contributory of the said company requiring a copy on payment of the regulated charge for the same.

In the matter of the Companies Act 1955, and in the matter of Tramway Road Energy Centre Limited, a duly incorporated company having its registered office at the corner of Tramway Road and Fifth Avenue, Hamilton, garage proprietor, florist, and food centre operator:

Notice is hereby given that a petition for the following orders:

A. That Michael Wayne Crawford and Ian McCormick Sommerville of Hamilton, chartered accountants, be jointly appointed receiver of the company to undertake the functions of management of the company until further order of the Court.

B. That an inspector be appointed by the Court to investigate the affairs of the company.

C. That Bank of New Zealand forthwith release to the receiver of the company the sum of $45,000.00 or such actual amount as presently stands to the credit of the account at the Chartwell Branch of the Bank of New Zealand under the style "Tramway Energy Centre Limited".

D. That the receiver forthwith reopens for trade the motor garage operated by the company situated at the corner of Tramway Road and Fifth Avenue, Hamilton.

E. That a meeting of the members of the company be convened at a time and place determined by the Court and chaired by one of the persons jointly appointed receiver or such other person as shall be nominated by the Court to determine whether a solution to the dispute as to the future shareholding and management of the company can be found and that the person appointed chairman report the outcome of the meeting to the Court.

F. That in the event that no resolution acceptable to the members is forthcoming from the meeting that the company be wound up by the Court and that orders be made as to the distribution of the assets of the company.

G. Such other order or orders as shall be just.

H. That the costs of your petitioner be paid out of the assets of the company.

Was presented to the High Court on the 2nd day of May 1988 by Kevin Laurence Paepeke of Cambridge, company director; and that the said petition is directed to be heard before the Court sitting at Hamilton on the 13th day of June 1988 at 10 o’clock in the forenoon; and any creditor or contributory of the said company desirous to support or oppose the making of the orders on the said petition may appear at the time of hearing in person or by his counsel for that purpose; and a copy of the petition will be furnished by the undersigned to any creditor or contributory of the said company requiring a copy on payment of the regulated charge for the same.
