Mining Act 1971

Exemption of Land From Mining

Pursuant to section 24 (1) (a) of the Mining Act 1971, the Minister of Energy hereby gives the following notice:

The land described in the Schedule hereto is hereby exempted from section 69 of the Mining Act 1971 in respect of the grant of mining licences which would permit mining operations to be carried out by or as part of a large-scale opencast mining operation, or by or as part of any mining operation that forms part of a large-scale opencast mining operation.

In this notice, the term "large-scale opencast mining operation" means any opencast mining operation that involves or will involve the removal or excavation of more than a total of 100 000 tonnes in any 1 year of overburden, rock, ore, mineral deposit, or other material.

Plans of the area to which this notice relates are held by the Chief Surveyor, Hamilton; the Inspector of Mines, Hamilton; and the Secretary of Energy, Wellington.

This notice shall come into force on the date of its publication in the Gazette and shall remain in force for a further period of 18 months from that date and shall then expire.

Schedule

South Auckland Land District—Thames-Coromandel District

All that area of land which is Crown land to which section 24 of the Mining Act 1971 applies or which is land to which section 26 of that Act applies that lies within the following area:

All that area in the South Auckland Land District containing 2212 square kilometres, more or less, commencing at the intersection in Block VII, Thames Survey District, of the mean-high water mark of the Firth of Thames with a right line bearing due west from I11X, S.O. 43457 and proceeding due westerly along the aforesaid right line to a point 669794.99 metres north and 368561.48 metres east of the false origin of Mount Eden Meridional Circuit; thence north-westerly along a right line to a point 674885.39 metres north and 365898.29 metres east of the said false origin; thence due easterly along a right line to the aforesaid mean-high water mark; thence generally northerly, generally south-easterly and generally southerly along the said mean-high water mark to the mouth of the Waihou River in Block XVI, Tairua Survey District; thence generally south-westerly up the middle of that river to its source in Block III, Ohinemuri Survey District; thence westerly along the middle of that stream to its confluence with the Waipaoa Stream in Block II, Ohinemuri Survey District; thence generally westerly down the middle of that stream to its confluence with the Waihou River in Block VIII, Waihou Survey District; thence generally northerly down the middle of that river to its mouth; thence generally northerly to and along the mean high-water mark to the point of commencement: including the islands of Wokaurua, Rangipukea, Whanganui, Motutapere, Waimate, Motukopake, Motuoruhi, (Goat), Ngamotukarakara (Three Kings), Motukaramarama (Bush), Motuwi (Double), Motukakaua (Happy Jack), Channel, Square Top, Cuvier, Great Mercury, Green, Korapuki, Middle, Stanley (Atiu), Double (Moturehu), Red Mercury (Whakau), Whale, Ohinauiti, Ohinau, Motukoruenga, Motukoranga, Motungararape, Motukokura, Motuweka, Mahurangi, Castle, The Aldermen, Shoe, Slipper (Whakahau), Penguin, Rabbit, Hauturu, Wheruaukura, Rawengaiti, and all other islands adjacent thereto and to the area herein described.

But excluding therefrom all parts of such land that are subject to mining licences that have been granted prior to the coming into force of this notice.

Land Act 1948

Reservation of Land

Pursuant to the Land Act 1948, and to a delegation from the Minister of Lands, the Assistant Director of Land Administration of the Department of Lands and Survey hereby sets apart the land, described in the Schedule hereto, as a recreation reserve subject to the provisions of the Reserves Act 1977.

830 square metres, more or less, being Lot 11, D.P. 9686, situated in Ocean Beach Survey District. Part Gazette notice 7585. Subject to Batter Rights created by Deed Volume 425, folio 73.

A PROCLAMATION

Pursuant to section 421 of the Maori Affairs Act 1953, I, The Most Reverend Sir Paul Alfred Reeves, the Governor-General of New Zealand, hereby declare the land described in the Schedule hereto and comprised in a roadway laid out by the Maori Land Court by order dated the 29th day of June 1910, to be road and to be vested in The Horowhenua County Council.

All that piece of land containing 7.5618 hectares, situated in Block I, Waitohu Survey District, being part Horowhenua.
