Customs Act 1966

Final Determination Pursuant to Section 186k of the Customs Act 1966

Pursuant to the provisions contained in section 186k of the Customs Act 1966, notice is hereby given by the Minister of Customs of a final determination in relation to the importation or intended importation into New Zealand from Australia of

“Aluminium passenger catamarans of 18 metres in length or longer”

that they are goods to which the provisions of section 186L of the Customs Act 1966 apply.

In accordance with the provisions of section 186L of the Customs Act 1966, the Minister further gives notice that there shall be charged, collected, and paid on demand of the Collector on the aforesaid goods a special duty of Customs to be known as anti-dumping duty; and there shall be charged, collected, and paid on demand of the Collector a special duty of Customs to be known as countervailing duty.

The anti-dumping duty in the case of goods to which this notice applies, and manufactured by North Queensland Engineers and Agents Pty Ltd., (NQEA Australia Pty Ltd.), Australia, shall be an amount equal to the difference between the export price of the goods and their normal value determined in accordance with the provisions of the Customs Act 1966, and shall be charged, collected, and paid on all such goods entered for home consumption pursuant to the provisions of the Customs Act 1966 on or after the date of this notice.

The countervailing duty in the case of goods to which this notice applies, and imported into New Zealand from Australia, shall be an amount equal to the amount of subsidy on those goods, and shall be charged, collected, and paid on all such goods entered for home consumption pursuant to the provisions of the Customs Act 1966 on or after the date of this notice.

Customs Exchange Rates Notice (No. 6) 1988

Pursuant to section 143 of the Customs Act 1966, the Comptroller of Customs, in accordance with the power delegated to him by the Minister of Customs under section 9 of that Act, hereby gives the following notice.

Notice

  1. Short title and commencement—(1) This notice may be cited as the Customs Exchange Rates Notice (No. 6) 1988.

(2) This notice shall come into force on the 14th day of March 1988.

  1. Exchange rates—Where under any provisions of the Customs Act 1966 any amount which is required to be taken into account for the purpose of assessing duty or any other purpose is not an amount in New Zealand currency, the amount to be so taken into account shall be the equivalent in New Zealand currency of that amount ascertained in accordance with the rate of exchange set out in the Schedule to this notice.

  2. Revocation—The Customs Exchange Rates Notice (No. 5) 1988, published in the New Zealand Gazette, No. 32, dated the 25th day of February 1988, on page 636 is hereby revoked.
