Australia New Zealand Closer Economic Relations Trade Agreement (ANZCERTA)
Unused 1987/88 Manufacturers Exclusive Australian Licences (MEALS)
Pursuant to the Import Control Regulations 1983, Amendment No. 3 (S.R. 1980/246), and the Australia–New Zealand Closer Economic Relations Trade Agreement (ANZCERTA), I, P. E. Donoven, Deputy Secretary of Trade and Industry, acting under delegated authority call tenders for the goods specified below. Tenders close on the 21st day of March 1988 at 5 p.m. and must be received by the Registrar of Tenderers by this time to be valid.
Terms and Conditions
Instructions for tenderers and the general terms and conditions which apply to the submission and acceptance of tenders for these goods are set out both in the Guide to Licence Tendering date November 1986, with the deletion of paragraphs 17 and 21J, and in the TEAL and MEAL Allocation Procedure dated March 1985. Bids may be submitted through the Department of Trade and Industry bureau-fax system. Tenders should be addressed to the Registrar of Tenderers, P.O. Box 3146, Wellington, or Bureaufax (04) 734 638, or be hand delivered to the First Floor, Bowen State Building, Bowen Street, Wellington.
Amounts for tender are the Manufacturers Exclusive Australian Licence (MEALS) which were taken up but not used in 1987-88 year.
Australian Origin Goods
All licences won in this tender round are available only for the importation of goods of Australian origin as defined in the Customs Regulations 1968, as amended. The New Zealand/Australia rules of origin are also detailed in Article 3 of the Australian–New Zealand Closer Economic Relations Trade Agreement.
Submission of Bids
All tenders close at 5 p.m. on Monday, 21st March 1988 with the Registrar, Import Licence Tendering, Department of Trade and Industry, P.O. Box 3146, Wellington.
No late tenders can be accepted. Tenders must be mailed to the above address in time to arrive before the closing time or be delivered by hand to the First Floor Reception, Bowen State Building, Bowen Street, Wellington. Envelopes should be clearly marked “ANZCERTA Import Licence Tender” on the bottom right-hand corner.
ANZCERTA Tender Rules
The rules for ANZCERTA import licence tendering differ from the rules for global licence tendering in two significant areas.
Where fewer bids are received than there is licence available, each bidder will receive the licence sought and no premiums are payable; residual licence will be available free of charge.
Where more bids are received than there is licence available, an initial limit on licence take-up is applied. Each bidder, ranked in bid order, is first given no more than the initial limit stated for the tender category concerned. Any licence then remaining is allocated to outstanding bids with no further limit.
However, please note that the terms and conditions set out in the Guide to Global Licence Tendering apply to the payment of premiums and disposition of unpicked up licence in the situation where a tender category is oversubscribed in bidding but required deposits are not paid during the 14 day deposit period.
Licence Period
Licences for goods in Part I below will be valid for 12 months from date of invoice. Goods which become exempt from global licence control on 1 July 1988 (in Part II below) will have licences issued only up till that date. Refunds for such goods after exemption will not be made.
MEAL Holders
Manufacturers are permitted to tender in the same item codes in which they currently hold MEALS provided they used at least 75 percent of any MEAL in the same item code they held in 1986-87.
Tender Amounts
All licences are tendered in units of $2,000 CIF. Tenderers may bid for all or any number of the units available. One invoice will be issued for the amount of the premium due for each tender.
Motor Vehicle Components—Appendix B
Access arrangements under ANZCERTA do not permit the use of TEALS for importation of many motor vehicle parts and components. Where this restriction applies licences won will be endorsed “excluding those of a kind commonly used with the vehicles specified in Appendix B”. A copy of Appendix B will be attached to the licence. It reads:
1 Pursuant to Annex C of the ANZCER Trade Agreement, in the item codes listed below, the Exclusive Australian Licences are only for goods EXCLUDING components of a kind commonly used with:
a Tractors for articulated vehicles, being tractors that are designed for operation solely or principally on the highway; or
b Vehicles of Tariff Heading 87.02, other than air-cushioned vehicles or assembled convertible road rail motor coaches.
