Land Acquired for Railway Purposes in Mount Maunganui Borough

Pursuant to section 20 of the Public Works Act 1981, and a delegation from the Minister of Lands, the Acting District Solicitor of Department of Lands, Hamilton, declares that an agreement to that effect having been entered into, the land described in the Schedule hereto is hereby acquired for railway purposes and shall vest in the Crown on the date of publication of this declaration in the Gazette.

All those pieces of land situated in Block XI, Tauranga Survey District, described as follows:

Road Realignment in Waikato County

Pursuant to Part VIII of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Manager of the Department of Lands, Hamilton:

(a) Pursuant to section 114, declares the land described in the First Schedule hereto to be road and vested in The Waikato County Council.

(b) Pursuant to sections 116, 117 and 119, declares the portions of road described in the Second Schedule hereto to be stopped and the area of land described in the Third Schedule hereto to be taken and further declares that:

(i) Area “C” in the Second Schedule hereto shall be dealt with as Crown land under the Land Act 1948.

(ii) Area “D” in the Second Schedule hereto and the land taken in the Third Schedule hereto, now together known as Section 1, S.O. 56812, shall be amalgamated with the land in certificate of title No. 32A/67, subject to memorandum of mortgage H.541000.7, South Auckland Land Registry.

Third Schedule

328 square metres situated in Block II, Cambridge Survey District, being part Section 28, Te Miro Township; as shown marked “E” on S.O. Plan 56812, lodged in the office of the Chief Surveyor at Hamilton.

Road Stopped in Otorohanga District

Pursuant to sections 116 and 117 of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Manager of the Department of Lands, Hamilton declares the portion of road described in the Schedule hereto to be stopped and further declares that the area of stopped road, now known as Section 3, S.O. 52911, shall be amalgamated with the land in certificate of title, Volume 1402, folio 1, subject to memorandum of mortgage S.593689, South Auckland Land Registry.

Road Realignment in Otorohanga District

Pursuant to Part VIII of the Public Works Act 1981, and to a delegation from the Minister of Lands, the District Manager of the Department of Lands, Hamilton:

(a) Pursuant to section 114, declares the land described in the First Schedule hereto to be road and vested in The Otorohanga District Council;

(b) Pursuant to section 119, declares the land described in the Second Schedule hereto to be taken;

(c) Pursuant to sections 116, 117 and 119, declares the portions of road described in the Third Schedule hereto to be stopped and

(i) That area “B” in the Second Schedule hereto and area “A” in the Third Schedule hereto, now together known as Section 1, S.O. 55895, shall be amalgamated with the land in certificate of title No. 26B/1238, subject to agreement H.712087 and to memorandum of mortgage H.669467.2 and H.493003, South Auckland Land Registry.

(ii) That area “F” in the Second Schedule hereto and area “G” in the Third Schedule hereto, now together known as Section 3, S.O. 55895, shall be amalgamated with the land in certificate of title No. 26B/1237, subject to agreement H.712087 and to memorandum of mortgage H.801251, South Auckland Land Registry.
