Decision

These publications were commercially imported in March 1988 through the port of Dunedin. The Collector having seized these issues the importer disputed forfeiture and the publications have been referred to the Tribunal prior to the commencement of condemnation proceedings pursuant to the Customs Act 1966.

Gent, Best of Gent and Super Stars

Most of these publications, which present sequences of photographs of naked and partially-clad female models, contain instances of the models in sexual activity of a degree of intimacy which causes the Tribunal concern. In respect of the Gent publication of November 1985 that presentation is of such a nature as to clearly be injurious to the public good and the Tribunal classifies that particular edition as unconditionally indecent. The remaining editions, although borderline, are of such a nature that the Tribunal is satisfied that an age restriction is appropriate. Accordingly, in respect of the remaining editions of these publications the Tribunal classifies each as indecent in the hands of persons under the age of 18 years.

All of these magazines predominantly feature single female models with very little, if any, text. The larger female breast is the major feature of all of these publications and the Tribunal is satisfied that they contain material which is likely to be injurious to younger readers. Each of these publications is accordingly classified as indecent in the hands of persons under the age of 18 years.

Sale of Liquor Act 1962

Sale of Liquor Amendment Act 1976

Notice of Intention to Vary Hours of Sale of Liquor at Licensed Premises—Auckland Licensing Committee

Pursuant to section 221A (14) of the Sale of Liquor Act 1962 as amended by section 22 (1) of the Sale of Liquor Amendment Act 1976, I, David Oughton, Secretary for Justice, hereby give notice that the Auckland Licensing Committee on 18 October 1988 made an order authorising variations of the usual hours of trading for the licensed premises known as the Trident Tavern, 67-73 Selwyn Street, Onehunga.

To the intent that on days other than those on which licensed premises are required to be closed for the sale of liquor to the general public the hours for the opening and closing of the said premises shall be as follows:

(a) On any Monday, Tuesday, Wednesday, Thursday, Friday and Saturday. Opening at 11 o’clock in the morning and closing at 10 o’clock in the evening.

(b) In respect of the public bar and club bar on Christmas Eve and New Year’s Eve. Opening at 11 o’clock in the morning and closing at 10 o’clock in the evening.

(c) In respect of the Lounge Bar on Christmas Eve. Opening at 11 o’clock in the morning and closing at 11 o’clock in the evening.

(d) In respect of the Lounge Bar on New Year’s Eve. Opening at 11 o’clock in the morning and closing at 00.30 o’clock in the morning of New Year’s Day.
