Broadcasting Act 1976
Before the Broadcasting Tribunal
Decision No. 23/88
In the matter of a complaint by Harold Earl Jensen of Wellington:
Chairman: Judge B. H. Slane.
Member: Robert Boyd-Bell.
Reason for Decision
Dated this 15th day of July 1988.
On 9 May 1988 Mr Jensen referred to the Tribunal a complaint under the Broadcasting Act concerning the contents of the New Zealand Listener, a magazine published by the Broadcasting Corporation of New Zealand.
The Broadcasting Corporation had rejected a complaint from Mr Jensen on the grounds that the Broadcasting Act did not provide a complaints procedure which applied to the New Zealand Listener.
The Corporation is correct. The complaints procedure in Part XIA relates to broadcast, not to printed publications. The Tribunal has no jurisdiction to deal with the complaint.
This decision does not rule one way or another on how the Broadcasting Corporation should deal with complaints about the contents of the Listener. It is for the Corporation to decide how it will deal with such complaints. There is no statutory procedure laid down.
The Corporation was correct in rejecting the complaint as not capable of being dealt with under the statutory provisions for complaints about broadcast programmes.
Signed for the Tribunal:
B. H. SLANE, Chairman.
