Notice of Decision of Disciplinary Committee of the New Zealand Society of Accountants
Notice is hereby given by the Disciplinary Committee of the New Zealand Society of Accountants that at a hearing held on 9 June 1988, Bryan James Mackay, chartered accountant of Auckland, was charged that he had been guilty of defaults discreditable to an accountant, had conducted himself in such a manner as to render the exercise of the powers of the disciplinary committee expedient in the interest of the public and of the society, and had been guilty of unprofessional conduct. The member had failed within a reasonable and proper time to reply to correspondence from the New Zealand Society of Accountants; made statements and payments from a company in circumstances when he knew or ought reasonably to have known that such statements were false and/or incorrect and/or misleading and/or open to misconstruction; gave creditors reason for confidence that they would receive payment in circumstances when there were no reasonable grounds for such confidence to exist; and that he would receive payment in circumstances when there were no reasonable grounds for such confidence to exist; and that he allowed or permitted debts to be incurred in circumstances when a company did not exist or was not properly constituted.
The disciplinary committee found all charges proven and censured the member. The committee imposed a penalty of $200.00 plus G.S.T. pursuant to section 24 (3) (c) of the New Zealand Society of Accountants Act 1958, and pursuant to section 24 (3) (e) of the same Act, ordered the member to pay the sum of $3,250.00 plus G.S.T. towards the costs of the inquiry by the disciplinary committee and the investigation by the investigation committee.
