Notice to Creditors to Prove Debts or Claims

Notice is hereby given that the undersigned, the liquidator of the above company which is being wound up, does hereby fix the 22nd day of July 1988 as the day on or before which the creditors of the company are to prove their debts or claims, and to establish any title they may have to priority under section 308 of the Companies Act 1955, or to be excluded from the benefit of any distribution made before the debts are proved or, as the case may be, from objecting to the distribution.

Notice is hereby given in pursuance of section 291 of the Companies Act 1955, that meetings of the members and creditors of the above-named companies will be held at the offices of Peat Marwick, 40 Atkinson Avenue, Otahuhu, on the 28th day of July 1988 for the purpose of having an account laid before the meetings showing how the winding up has been conducted and the property of the company has been disposed of, and to receive any explanations thereof by the liquidator.

Every member or creditor entitled to attend and vote at the meetings is entitled to appoint a proxy to attend and vote instead of him. A proxy need not also be a member or creditor respectively.

Proxies to be used at the meetings must be lodged at the offices of Peat Marwick, P.O. Box 22-481, Otahuhu, not later than 4 o’clock in the afternoon on the 27th day of July 1988.

"That a declaration of solvency having been filed in accordance with section 274 (2) of the Companies Act 1955, the company be wound up voluntarily."

And furthermore notice is hereby given that the undersigned, the liquidator of Misty Hills Ltd. (in liquidation) which is being wound up voluntarily, does hereby fix the 29th day of July 1988 as the day on or before which the creditors of the company are to prove their debts or claims, and to establish any title they may have to priority under section 308 of the Companies Act 1955 or to be excluded from the benefit of any distribution made before the debts are proved or, as the case may be, from objecting to the distribution.
