In the matter of the Companies Act 1955, and in the matter of Bates Caterers Limited, a duly incorporated company having its registered office at 208 Oxford Terrace, Christchurch:
Notice is hereby given that a petition for the winding up of the above-named company by the High Court was, on the 18th day of May 1988, presented to the said Court by Canterbury Office Supplies Limited, a duly incorporated company having its registered office at Christchurch; and that the said petition is directed to be heard before the Court sitting at Christchurch on the 4th day of July 1988 at 10 o’clock in the forenoon; and any creditor or contributory of the said company desirous to support or oppose the making of an order on the said petition may appear at the time of hearing in person or by his counsel for that purpose; and a copy of the petition will be furnished by the undersigned to any creditor or contributory of the said company requiring a copy on payment of the regulated charge for the same.

The notice must state the name, address, and description of the person, or if a firm, the name, address, and description of the firm, and an address for service within 5 kilometres of the office of the High Court at Christchurch, and must be signed by the person or firm, or by his or their solicitor (if any), and must be served, or, if posted, must be sent by post in sufficient time to reach the above-named petitioner’s address for service not later than 4 o’clock in the afternoon of the 1st day of July 1988.

The humble petition of Diners Club (N.Z.) Limited, a duly incorporated company having its registered office at Auckland, credit card organisation, showeth as follows:

Advanced Technology Distributors Limited (hereinafter called "the company") was in the month of May 1966 incorporated under the Companies Act 1955.

The registered office of the company is at the premises of Cox Arcus & Co., Third Floor, 35 Albert Street, Auckland.

The nominal capital of the company is $100,000.00 divided into 100,000 ordinary shares of $1.00 each. The amount of the capital paid up or credited as paid up is $100,000.00.

The objects for which the company was established are as follows:
To carry on the business of printers, engravers, publishers, book and print sellers, book binders and art journalists in all their branches;
and other objects set forth in the memorandum of association thereof.

The company is indebted to your petitioner in the sum of $4,118.10 being the amount due in respect of credit card charges incurred between November 1987 and February 1988.

Your petitioner has made demand under its hand requiring the company to pay the sum so due, such demand being left at the company’s registered office on the 26th day of April 1988, but the company has for 3 weeks thereafter neglected to pay the sum of $4,118.10 or to secure or compound for it to the reasonable satisfaction of your petitioner.

The company is insolvent and unable to pay its debts.

In the circumstances it is just and equitable that the company should be wound up.
Your petitioner therefore humbly prays as follows:
(i) That Advanced Technology Distributors Limited may be wound up by the Court under the provisions of the Companies Act 1955; or
(ii) That such other order may be made as in the premises shall be just.
This petition is filed by G. BOGIATTO, solicitor for the petitioner, whose address for service is at the offices of Grove Darlow & Partners, Solicitors, Third Floor, Guardian Assurance Building, corner Queen and Darby Streets, Auckland 1.
