Marlborough Electric Power Board Electricity Supply Licence
1987
J, Robert James Tizard, Minister of Energy, acting pursuant to section 20 of the Electricity Act 1968, hereby license Marlborough Electric Power Board hereinafter called the Electrical Supply Authority to supply electricity, and to lay, construct, put up, place and use the electric lines and works which may from time to time be required for the distribution and supply of electricity within the area specified in the Schedule hereto. This licence is issued subject to the following conditions:
CONDITIONS

This licence may be cited as the Marlborough Electric Power Board Electricity Supply Licence 1987.

The Electrical Supply Authority shall comply with the provisions of this licence, the Electricity Act 1968 and all enactments made in amendment of or substitution for that Act, any Electrical Codes of Practice made under that Act, the Electrical Wiring Regulations 1976 and all regulations made in amendment of or substitution for any of those regulations.

Any notice to be given to the Electrical Supply Authority shall be sufficient if sent by registered post letter to the offices of the Electrical Supply Authority.

Any notice to be given on the part of the Minister of Energy shall be sufficient if given in writing signed by the Minister or by any person acting under the authority of the Minister.

Any notice to be given to the Minister of Energy shall be sufficient in writing to or sent by registered post letter addressed to the Secretary of Energy, Ministry of Energy, Wellington.

This licence shall not be construed as granting a consent to generate electricity pursuant to section 25 of the Electricity Act 1968.

This licence shall come into force on the 1st day of April 1987 and shall continue in force for a period of 21 years from that date unless it is sooner lawfully determined in accordance with clauses 8 or 9 hereof.

The Governor-General in Council may pursuant to section 22 of the Electricity Act 1968 cancel this licence if the Electrical Supply Authority is in breach of the provisions contained in clause 2 of these conditions.

This licence may be cancelled by the Minister of Energy at the request of or with the consent of the Electrical Supply Authority.

At the expiry or cancellation of this licence, the Electrical Supply Authority shall be required by notice in writing by the Minister of Energy remove all buildings, poles and other erections and all transmission lines, plant and other machinery and other removable equipment authorised by the licensee to be erected, installed or provided and if within 12 months after being so required the Electrical Supply Authority fails or neglects to remove the same, then the same shall, without payment of any compensation vest in and become the property of the Crown and it shall be lawful for any person authorised by the Minister of Energy in that behalf, subject to compliance with section 15A of the Electricity Act 1968 to enter upon any land or premises and take possession of and remove the same or any part thereof.

Nothing contained in the licence, either expressly or by implication shall be deemed to authorise the Electricity Supply Authority to erect, construct or maintain any lines or works except subject to such conditions (not inconsistent with this licence) as may from time to time be lawfully imposed by any local authority within the district of which any such lines or works may be situated.

The systems of supply shall be described in paragraphs (a), (b), (c), (d), (e), (f), (h) and (j) of regulation 13 of the Electrical Supply Regulations 1984. The system of supply authorised under paragraph (j) aforesaid shall be a single conductor earth-return system and the use thereof shall be subject to such terms and conditions as from time to time laid down by the Assistant Secretary of the Ministry of Energy at Wellington.

The Electrical Supply Authority shall, 6 months prior to the expiry of the term of this licence provided in clause 7 herein, make written application to the Minister of Energy for the granting of a new licence.
SCHEDULE
AREA OF SUPPLY
All that area in the Nelson and Marlborough Land Districts bounded by a line commencing at a point on the sea coast in the middle of the mouth of the Oahu Stream in Block XV, Puhi Puhi S.D. and proceeding generally northerly along the middle of said stream to the north-western boundary of Section 4A of 2 Mangamaunu Maori Block; thence along the south-eastern, eastern, and north-eastern boundaries of Small Grazing Run 106 and the north-eastern boundary of Small Grazing Run 105B to Trig Station R (George Spur) Block VII, Kaitarau S.D.; thence along the north-eastern boundary of Run 205 and that boundary produced to the middle of the Jam Stream; thence northerly along the middle of said stream to the right bank of the Clarence River; thence generally south-westerly along said bank to a point due west of Mount Ross, Block X, Acheron S.D.; thence due west to the middle of the Clarence River; thence southerly along the middle of said river to its intersection with a right line between the confluence of the Acheron and Clarence Rivers and the Palmer Saddle in Block XI, Acheron S.D.; thence south-westerly along said right line to the confluence of Acheron and Clarence Rivers; thence generally north-easterly along the middle of the Acheron and Guide Rivers to Trig Station BOC Barefell Pass, Block III, Severn S.D.; thence north-westerly along a right line to Trig Station Top O, Block II, Raglan S.D.; thence north-easterly along a right line to Ward Pass on the summit of the Richmond Range; thence generally north-easterly along the summit of said range passing through Bushy Top, Bischofs Cap and Mount Rintoul to and along the summit of the Bryant Range to the source of the Pelorus River (being approximately 2000 metres southeast of Slaty Peak); thence generally north-easterly along the middle of said river to and generally north-westerly along the middle of Hacket Creek to its source on Saddle Hill; thence north-westerly to the summit of Saddle Hill to and north-easterly along the summit of the Bryant Range passing through Mount Duppa and Rai Saddle to South Castor Peak; thence northerly along a right line to Charles Heads in Block IV, Whakapuaka S.D. and the production of the last-mentioned right line to the sea coast; thence generally north-easterly along the sea coast to Pukerau Point; thence due north to the intersection with the parallel of latitude 40° 30' south; thence due east along said parallel to its intersection with the meridian of longitude 174° 30' east; thence due south along said meridian to a point due east of a point on the shore of Island Bay in Block XIV, Arapawa S.D. in line with the south-western boundary of Section 4, Block XIV aforesaid; thence due west to the said point on the shore of Island Bay and generally south-westerly along the sea coast to the point of commencement.
The area of supply being more particularly shown outlined in black on plan NZE 2138 (Sheets 1 to 14), deposited in the office of the Ministry of Energy at Wellington.
