Buller Electric Power Board Electricity Supply Licence 1987
- Robert James Tizard, Minister of Energy, acting pursuant to section 20 of the Electricity Act 1968, hereby licence Buller Electric Power Board, hereinafter called the Electrical Supply Authority to supply electricity, and to lay, construct, put up, place and use all electric lines and works which may from time to time be required for the distribution and supply of electricity within the area specified in the Schedule hereto.
This licence is issued subject to the following conditions:
CONDITIONS

This licence may be cited as the Buller Electric Power Board Electricity Supply Licence 1987.

The Electrical Supply Authority shall comply with the provisions of this licence, the Electricity Act 1968 and all enactments made in amendment of or substitution for that Act, any Electrical Codes of Practice made under that Act, the Electrical Wiring Regulations 1984, the Electrical Supply Regulations 1984 and all regulations made in amendment of or substitution for any of those regulations.

Any notice to be given to the Electrical Supply Authority shall be sufficient if sent by registered post letter to the offices of the Electrical Supply Authority.

Any notice to be given on the part of the Minister of Energy shall be sufficient if given in writing signed by the Minister or any person acting under the authority of the Minister.

Any notice to be given to the Minister of Energy shall be sufficient if given in writing to or sent by registered post letter addressed to the Secretary of Energy, Ministry of Energy, Wellington.

This licence shall not be construed as granting a consent to generate electricity pursuant to section 25 of the Electricity Act 1968.

This licence shall come into force on the 1st day of April 1987 and shall continue in force for a period of 21 years from that date unless it is sooner lawfully determined in accordance with clauses 8 or 9 hereof.

The Governor-General in Council may pursuant to section 22 of the Electricity Act 1968 cancel this licence if the Electrical Supply Authority is in breach of the provisions contained in clause 2 of these conditions.

This licence may be cancelled by the Minister of Energy at the request of or with the consent of the Electrical Supply Authority.

At the expiry or cancellation of this licence, the Electrical Supply Authority shall as required by notice in writing by the Minister of Energy remove all buildings, poles and other erections and all transmission lines, plant and other machinery and other removable equipment authorised by the licence to be erected, installed or provided and if within 12 months after being so required the Electrical Supply Authority fails or neglects to remove the same, then the same shall without payment of any compensation vest in and become the property of the Crown and it shall be lawful for any person authorised by the Minister of Energy to enter upon any land or premises and take possession of and remove the same or any part thereof.

Nothing contained in the licence either expressly or by implication shall be deemed to authorise the Electrical Supply Authority to erect, construct or maintain any lines or works except subject to such conditions (not inconsistent with this licence) as may from time to time be lawfully imposed by any local authority within the district of which any such lines or works may be situated.

The systems of supply shall be as described in paragraphs (a), (b), (c), (d), (e), (f) and (g) of regulation 13 of the Electrical Supply Regulations 1984.

The Electrical Supply Authority shall, 6 months prior to the expiry of the term of this licence provided in clause 7 hereof, make written application to the Minister of Energy for the granting of a new licence.
SCHEDULE
Area of Supply
All that area in the Nelson Land District bounded by a line commencing on the sea coast in the middle of the mouth of the Kahurangi River and proceeding generally southerly along the middle of said river and along the north branch of said river to the summit of Saxon Ridge; thence along the summit of said ridge to and south-easterly along the summit of the Tuhunan Range passing through Trig Station T753, Mounts Teddy, Tubman, Goul and Gouland to and south-westerly along the summit of the Gouland Range passing through Trig Stations F, G (Flanagan) and D (Munel) to the summit of the Domett Range; thence southerly, north-easterly, easterly and southerly along the summit of said range passing through Amohia Peak, Mount Centre, Aorere Peak and Mt Cobb to and southerly along the summit of Peel Range passing through Mount Prospect, Mount Ranolf, Mount Peel and Trig Station C (Balloon Hill) and along the summit of Pyramid Ridge passing through Trig Station H (Tableland) and Gordons Pyramid to the summit of the Arthur Range; thence southerly along the summit of the Arthur Range passing through The Twins, Trig Station T, Mounts Star, Sodom, Gomorrah, Baldy and Luna and along the summit of the Matiri Range passing through The Haystack to the summit of the Lyell Range; thence westerly and southerly along the summit of said range passing through Bald Hill and southerly along a spur that runs between the said Bald Hill and the mouth of the Eight Mile (or Boundary) Creek to the northern boundary of Block II, Maruia S.D.; thence westerly along the northern boundaries of Block II and Block I, Maruia S.D. to the eastern boundary of Reserve No. 5, thence along the eastern and northern boundaries of said Reserve No. 5 and Section 9 (Scenic Reserve); thence westerly along a right line to the south-eastern corner of Section 13, Block XVI, Orikawa S.D.; thence along the eastern boundaries of said Section 13 and Section 16, Block XVI, Orikawa S.D. and the southern, eastern and northern boundaries of Section 17, Block XVI aforesaid and the last-mentioned boundary produced to the middle of New Creek; thence southerly along the middle of said creek to a point in line with the northern boundary of Section 2, Block XVI, Orikawa S.D.; thence westerly to and along that boundary and that boundary produced to the western boundary of Block XVI, Orikawa S.D.; thence southerly along the western boundaries of said Block XVI and Block III, Inangahua S.D. and westerly along the northern boundaries of Blocks V and IV, Inangahua S.D. to the middle of the Buller River; thence south-westerly along the middle of said river to a point in line with the western boundary of Section 1, Block VIII, Ohika S.D.; thence southerly to and along that boundary and along the southern boundary of said Section 1 and the western and southern boundaries of part Section 54, Block VIII, Ohika S.D. to the south-eastern corner of said part Section 54; thence southerly along a right line to Trig Station BB (Berlins Bluff), Block VIII, Ohika S.D. on the summit of the Paparoa Range; thence generally south-westerly along the summit of said range passing through Mounts Uriah, McAubrey, Faraday and Priestley to the northern boundary of Block XII, Brighton S.D.; thence westerly along the northern boundaries of said Block XII and Blocks XI, X and IX, Brighton S.D. to the sea coast at Iriamauwera Bay; thence generally northerly along the sea coast to the point of commencement.
The area of supply being more particularly shown outlined in black on plan NZE 2142 (Sheets 1 to 11) deposited in the office of the Ministry of Energy at Wellington.
