Radich, counsel on behalf of the Porirua City Council and Amanda McDonald, counsel on behalf of the Registrar of Companies, this Court orders:

  1. That the name of SENAT PROPERTIES LIMITED be restored to the Register of Companies at Wellington.

  2. That the company be placed in the same position as nearly as may be as if the name had not been struck off the Register.

  3. That the applicant, Porirua City Council, undertakes that immediately upon the restoration of SENAT PROPERTIES LIMITED to the Register, the Solicitors for the Porirua City Council will issue a notice under section 218 of the Companies Act 1955 and, if grounds exist, will issue a winding up petition against the company.

  4. In the case of creditors not statute barred as at the date of the company being struck off the Register, the period between that date and the date at which the company is restored to the Register shall not be counted for the purposes of the Limitation Act 1950.

  5. That the applicant is to advertise the matter of the company’s restoration to the Register once in the Gazette and once in a daily newspaper circulating in the Wellington area.

  6. That the costs of and incidental to this application be fixed at $250.00 together with disbursements; such disbursements to include the advertising of the restoration of the company to the Register. Such costs are to be payable by the company.
