This application involves the setting up of a television station for continuous broadcasting over a lengthy period and is more in the nature of a full warrant current for a 6 month period.
The Tribunal has completed hearing the evidence and submissions of all applicants in respect of the warrants for private regional television stations in New Zealand and is at present considering its decisions on those applications.
It is not appropriate for the Tribunal to consider a further application for a means of broadcasting television from an organisation which is already an applicant for a television broadcasting warrant. That first application is still under consideration by the Tribunal, together with all the other applications filed at the same time. While determination of all those applications is still pending, the Tribunal considers it cannot consider an alternative application filed by one of the parties.
The Tribunal is now being asked to consider a temporary station proposal which would involve a full-time commercial service. This would impact on existing television and radio stations and require a hearing to assess that impact. It would not be fair to those awaiting decisions on warrant applications to cause delay so such a proceeding could be undertaken.
It is also part of the general policy of the Government that private regional television be developed without delay.
There appears to be no reason for deferring the application until after a decision on the warrant applications. If this applicant were successful a full-time warrant would be available to it.
If this applicant were not successful, it would not be reasonable to grant a short-term authorisation to an unsuccessful warrant applicant without another full hearing, since it is unlikely a successful warrant application would want to tolerate an unsuccessful applicant providing a continuous service. Any grant then would require the Minister’s permission.
If there were no successful warrant applicant, the appropriate procedure would not be to deal with one particular proposal in isolation from alternative competing applications.
In all the circumstances the Tribunal considers it should decline the application rather than adjourn it.
Accordingly the application is declined.
