Notice of Intention to Hold Inquiry into Operation of Licence

TO Colin John Hoare (referred to below as the licensee) and to the
Secretary for Transport:

TAKE notice that pursuant to section 140 of the Transport Act 1962
the Licensing Authority for the No. 8 Transport District will hold
an inquiry into the operation of service conducted under Transport
Service Licence No. 20098 to determine:

(a) Whether owing to changed circumstances the service meets
the criteria set out in section 123 of the Transport Act;

(b) Whether the licensee has failed to comply with the terms of
his licence;

(c) Whether the licensee knowingly supplied false information in
applying for his licence.

The Licensing Authority suspects:

(a) That the service provided by the licensee no longer meets the
criteria set out in section 123 of the Transport Act;

(b) That the licensee has failed to comply with the terms and
conditions of his licence;

(c) That the licensee knowingly supplied false information in
applying for his licence.

Upon the Grounds

That he has been informed by Alfred Hayden Levick, an
investigating officer for the Secretary for Transport, that complaints
have been received from passenger service operators running
scheduled services in the No. 8 District that the licensee has breached
the provisions of section 129 of the Transport Act 1962 in that he
is carrying on a scheduled service through specified localities which
are not authorised by his licence.

The inquiry will be held at 10.45 a.m. on the 14th day of May
1987 at the District Court, Bridge Street, Nelson.

The licensee and the Secretary for Transport are entitled to appear
and be heard at this inquiry, and may be represented by a lawyer
or other agent.

Any of those persons or bodies may seek further information
regarding the inquiry from the undersigned.

Notice Declaring Lands to be Infected Areas Under Potato Cyst
Nematode Regulations 1974 (No. 4009; Ag. 12/8/8/2)

PURSUANT to regulation 3(1) of the Potato Cyst Nematode
Regulations 1974, notice is hereby given that the following lands
are declared to be infected areas:

(a) The land on which potato cyst nematode has been found:

An area of 2.0234 hectares, more or less, situated north
of and adjoining Sawyers Arms Road, Harewood, in Block
VI of the Christchurch Survey District, being Lot 2 of
Deposited Plan 23054, part Rural Section 1186, certificate
of title 10A/95.

(b) Other land within a radius of 80 kilometres of the land
described in paragraph (a) above being:

An area of 2.0234 hectares, more or less, situated north
of and adjoining Sawyers Arms Road, Harewood, in Block
VI of the Christchurch Survey District, being Lot 3 of
Deposited Plan 23054, part Rural Section 1186, certificate
of title 10A/96.

Amending Notice to the Open Season for Game in the Central
North Island Wildlife Conservancy Acclimatisation District 1987
Season: Canada Goose

THE notice published in the supplement to the New Zealand Gazette,
No. 37, of 19 March 1987, at page 1304 relating to shooting hours
and duration of season for Canada goose is amended as follows:

In that portion of the Second Schedule which relates to the Central
North Island Wildlife Conservancy Acclimatisation District.

During the period of 6 June to 28 June 1987 inclusive, Canada
goose may be hunted or killed 24 hours per day in that area situated
between the Wairoa River mouth and the Nuhaka River estuary,
and south of the Gisborne - Wairoa railway line.

Before the Broadcasting Tribunal

IN the matter of the Broadcasting Act 1976, and in the matter of
a complaint by NOEL VICKERS FRYKBERG of Pauanui Beach,
retired:

RULING

Mr Frykberg lodged a complaint with the corporation by letter
dated 5 June 1986 alleging biased reporting of news concerning the
Republic of South Africa and he alleged:

“(1) That the news as shown on TV cannot be called objective
as these reports are all culled from overseas reporters’
footage and no effort is made to explain why there is a
police presence at funerals organised by the militant wings
of the ANC and UIF.

(2) Radio and TV give constant reports from the political
wings of the ANC and UIF and nothing in rebuttal by the
South African Government Ministry of Information, or
from informed South Africans, both black and white who
do not support terrorism.

(3) No coverage of news events from newsmen employed by South
African press, radio and TV.

(4) A barrage of phone calls from newsmen representing the
overseas media.

(5) Lack of objective reporting and to cite 1 such case, in 1985 5
million black South Africans gathered in the Transvaal and
had as the guest of honour, the President of South Africa.
Peace and co-operation were the theme: no mention was
made of this in New Zealand by radio, no coverage by TV
of an event that represented approximately 20 percent
of South Africa’s total population.

(6) Lack of coverage of the rugby series just played in the republic,
except to highlight controversial issues.”

He submitted that the corporation was obliged to see that when
controversial issues were presented, some effort should be made to
present “the other point of view”.

The corporation answered these complaints at length when it wrote
on 6 August 1986 declining to uphold the complaints.

Mr Frykberg was dissatisfied with the answers and referred the
complaint to the Broadcasting Tribunal.

He then introduced more detailed allegations and responses which
had been set out in a letter to the tribunal dated 9 September 1986.

The corporation sent a detailed reply to the complaint to the
tribunal and in particular satisfied the tribunal that some of the
allegations made could not be sustained.
