Notice of Decision of the Disciplinary Committee of the New Zealand Society of Accountants

Notice is hereby given by the Disciplinary Committee of the New Zealand Society of Accountants, that at a hearing held on 21 May 1987 and 20 July 1987, Maurice Neville Halligan of Wellington, was charged in terms of section 24 of the New Zealand Society of Accountants Act 1958, that he had been guilty of defaults discreditable to an accountant, that he had conducted himself in such a manner as to render the exercise of the powers of the disciplinary committee expedient in the interest of the public and of the society, and that he had been guilty of unprofessional conduct.

The disciplinary committee found the charges proven and suspended Mr Halligan from membership of the society for a period of 3 years. He was ordered to pay to the society the sum of $15,000 plus GST towards the cost of the enquiry by the disciplinary committee and the investigation by the investigation committee.

The member had offered accounting services under the designation, chartered accountant, when not the holder of a certificate of public practice; in breach of a directive from the society he had continued to use professional letterheads with the designations taxation consultant and management consultant when not permitted to do so; he had withheld a client’s tax refund and when payment was made the cheque was deliberately back dated thus making it stale when received by the client; he had formed a trust of which he was to be sole trustee in circumstances when he had failed to ensure the parties to the trust received independent professional advice; in a letter to a client he had made unprofessional statements which were intimidating and/or vindictive; and in the course of the investigations the member had attempted to mislead the society’s investigation committee and its investigator.

An appeal against the costs ordered by the disciplinary committee, and heard by the society’s committee of appeal on 14 October 1987, was dismissed and additional costs of $1,351 plus GST were ordered to be paid by the appellant.
