Declaring Air Space to be Subject to Certain Restrictions for Telecommunications Purposes in the County of Whangarei

Pursuant to section 187 of the Public Works Act 1981, the Minister of Works and Development hereby prohibits (except with his consent):

(i) The erection or placing or extension of any building, pole, mast, or other structure of any kind; or

(ii) The growing of any tree

on the part Horahora No. 2 Block (part certificate of title, Volume 1079, folio 28, North Auckland Land Registry) within the space described in the Schedule hereto.

This prohibition is considered necessary to ensure the efficient functioning of the microwave radio path from the Mount Maunu radio tower to the Whangarei main telephone exchange tower. It is necessary that continuous and uninterrupted transmission through this microwave radio path is maintained.

Copies of S.O. Plan 62219 on which the air space is defined are held in the office of the District Commissioner of Works, Bledisloe Building, Myers Street, Auckland, and in the Whangarei office of the Ministry of Works and Development in Manala House, Rathbone Street, Whangarei, and may be inspected between the hours of 9 a.m. and 4 p.m. on any day when Government offices are open to the public.

North Auckland Land District

All that portion of air space above the area marked “A” on S.O. Plan 62218 (lodged in the office of the Chief Surveyor at Auckland), lying between the heights of 223.27 and 243.27 metres above mean sea level at the point marked A’ on the said plan, and between heights of 221.23 and 241.23 metres above mean sea level at point marked A on the said plan, the plane between the two upper limits and also the plane between the two lower limits having a slope of +2° 35’ 57’’; as depicted in diagram A on the said plan.

This prohibition is considered necessary to ensure the efficient functioning of the microwave radio path from the Mount Maunu microwave station to the Whangarei main telephone exchange tower. It is necessary that continuous and uninterrupted transmission through this microwave radio path is maintained.

Plan 62218 referred to in the Schedule may be inspected at the Whangarei office of the Ministry of Works and Development and Mania House, Rathbone Street, Whangarei and of the District Commissioner of Works, Bledisloe Building, Myers Street, Auckland, between the hours of 9 a.m. and 4 p.m. on any day when Government offices are open to the public.

Declaring Road in the Town District of Hikurangi, to be a Government Road and to be Stopped

Pursuant to the Public Works Act 1981, the Minister of Works and Development hereby:

(a) Declares the piece of road described in the Schedule hereto to be a Government road, and

(b) Stops the said road.
