Amending a Notice Declaring Road to be Stopped in Blocks III and IV, Piako Survey District, Hauraki Plains County

Pursuant to section 55 of the Public Works Act 1981, the Minister of Works and Development declares the notice dated the 11th day of September 1985 and published in Gazette, 19 September 1985, No. 173, page 4092, declaring road to be stopped in Blocks III and IV, Piako Survey District, Hauraki Plains County, pursuant to Part VIII of the Public Works Act 1981, to be amended by omitting paragraph (b) of the operative clause thereto and substituting the following:

“(b) Pursuant to section 117 declares that:

(i) The stopped road described in the First Schedule hereto, now known as Sections 28, 29, 30, Block III, Piako Survey District, respectively shall be amalgamated with the land in certificate of title, Volume 666, folio 225, subject to caveat H. 603468.6, South Auckland Land Registry.

(ii) The stopped road described in the Second Schedule hereto, now known as Sections 127, 129, 130, 131, Block IV, Piako Survey District, respectively shall be amalgamated with the land in certificate of title, Volume 745, folio 247, subject to memoranda of mortgage S. 316482, S. 486499 and caveat H. 706932, South Auckland Land Registry.

(iii) The stopped road described in the Third Schedule hereto, now known as Section 128, Block IV, Piako Survey District, shall be amalgamated with the land in certificate of title, Volume 1720, folio 76, subject to memorandum of mortgage S. 486499 and caveat H. 706932, South Auckland Land Registry.”

Land Held for the Use, Convenience and Enjoyment of a Motorway Acquired for Road in the City of Takapuna

Pursuant to sections 20 and 50 of the Public Works Act 1981, the Minister of Works and Development declares the land described in the Schedule hereto to be acquired for road which shall vest in The Takapuna City Council on the 19th day of November 1987.

Amending a Notice Stopping Road in Block XII, Maramarua Survey District, Waikato County

Pursuant to section 55 of the Public Works Act 1981, the Minister of Works and Development hereby amends the notice dated the 21st day of November 1985 and published in New Zealand Gazette, 28 November 1985, No. 220, page 5378 by omitting all reference to mortgage H. 541350.3.

Land Declared to be Road, Road Stopped and Land Taken in Blocks X and XI, Whakatane Survey District, Whakatane District

Pursuant to Part VIII of the Public Works Act 1981, the Minister of Works and Development:

(a) Pursuant to section 114 declares the land described in the First Schedule hereto to be road and vested in The Whakatane District Council.

(b) Pursuant to section 116 declares the portions of road described in the Second Schedule hereto to be stopped.

(c) Declares the land described in the Third Schedule hereto to be taken under section 119 (i).

(d) Pursuant to section 117 declares that the area of stopped road firstly described in the Second Schedule hereto now known as Allotment 752, Parish of Waimana, shall be amalgamated with the land in certificate of title No. 26A/1116, subject to memorandum of mortgage No. H. 349345.2, South Auckland Land Registry.

(e) Pursuant to sections 117 and 119 declares that the area of stopped road ninthly described in the Second Schedule hereto and the area of land taken described in the Third Schedule hereto now known together as Allotment 766, Parish of Waimana, shall be amalgamated with the land in certificate of title No. 26A/1117, subject to memorandum of mortgage No. H. 349345.2, South Auckland Land Registry.

(f) Pursuant to section 117 declares that the areas of stopped road secondly to sixthly described in the Second Schedule hereto now known as Allotments 753, 756, 769, 771 and 773, Parish of Waimana respectively, the areas of stopped road seventhly and eighthly described in the Second Schedule hereto now known together as Allotment 754, Parish of Waimana, shall vest in Leonard James Eastwood the younger of Pukerua Bay, milk roundsman, subject to memoranda of mortgage No. S. 403664 and H. 200589, South Auckland Land Registry.
