(4) The Local Elections and Polls Act 1976, the Local Government Act 1974 and the Local Government (Electoral and Survey) Regulations 1986 shall, subject to any necessary modifications, apply in respect of the holding of the first general election of the county council.
(5) The Principal Administrative Officer holding office pursuant to clause 6 of this order is to inform the Secretary for Local Government of the date on which the Returning Officer declares the result of the election of the members of the new Wanganui County Council.
- Membership of Council—(1) Until the general election of the members of the county council to be held in 1992 the county council shall comprise 10 members who shall be elected as follows:
Two members to be elected by the electors of the Brunswick-Westmere Riding;
One member to be elected by the electors of the Otamatea Riding;
One member to be elected by the electors of the Raorikia Riding;
One member to be elected by the electors of the Waitotara Riding;
One member to be elected by the electors of the Kai Iwi Riding;
One member to be elected by the electors of the Kauangaroa-Purua Riding;
One member to be elected by the electors of the Mangawhero Riding;
One member to be elected by the electors of the Mangamahu Riding;
One member to be elected by the electors of the Morikau-Upokongaro Riding;
(2) The county council is to have a chairman who shall be elected by the council from among its members.
- Chairman, Principal Administrative Officer and Other Officers—(1) The chairman of the county council shall have and may exercise and be responsible for the duties, powers and functions of the chairmen of the uniting authorities.
(2) The principal administrative officer of the county council is to be the person who at the commencement of this order holds the office of the County Manager of the former Wanganui County Council, and shall have and may exercise and be responsible for the duties, powers and functions of the principal administrative officers of the uniting authorities.

First Meeting of Council—The first meeting of the county council is to be convened by the person holding the office of County Manager of the Wanganui County Council immediately before this order comes into effect.

Otamatea and Putiki Communities—The Otamatea and Putiki Communities and Community Councils shall ensure as if they had been constituted by the county council.

Wanganui United Council—(1) The county council shall appoint two members to the Wanganui United Council.
(2) Those members of the Wanganui United Council appointed separately by each of the uniting authorities shall continue in office until such time as successors are appointed following the triennial elections of local authorities to be held in 1989.
- Finance—(1) Except as otherwise provided in this order the accounts of the county council shall be kept in accordance with the provisions of the Local Government (Territorial Authorities) Accounting Regulations 1979.
(2) For all accounting and other financial purposes the union shall be deemed to have taken place at the commencement of the financial year in which this order comes into force.
(3) The special funds of the uniting authorities are to be expended only for the purposes for which they were set aside.
(4) The loan liabilities existing at the date of the commencement of this order shall continue to be secured against the areas over which they are secured as at that date.

Petroleum Tax—For the purposes of Part XI of the Local Government Act 1974 the county council shall be the successor of the uniting authorities.

Town and Country Planning—(1) The county council shall forthwith prepare a new district scheme for the whole of the united county.
(2) The district planning schemes, and codes of ordinances in force in the respective districts of the uniting authorities shall be deemed to be the district planning scheme, and scheme statement, and code of ordinances of the united county, and shall remain operative until the district scheme required to be prepared pursuant to subclause (1) of this clause comes into force.
- Transfer of Responsibilities—Except as otherwise provided in this order, the county council, in respect of the districts of the uniting authorities:
(1) Shall have and may exercise and be responsible for all the powers, duties, acts of authority and functions which were previously exercised or which would have been so exercised by the uniting authorities;
(2) Shall have and may exercise and be responsible for all liabilities, obligations, engagements and contracts which previously were, or which would have been, the responsibility of the uniting authorities;
(3) Shall have and may exercise and be responsible for all actions, suits, and proceedings pending by or against the uniting authorities or which would have been the responsibility of the uniting authorities;
(4) Shall succeed to the bylaws which are in force in the districts of the uniting authorities and which are applicable to the county council’s circumstances and, until revoked or altered by the county council, every such bylaw shall remain in force in the area in which it was in force immediately before the commencement of this order and every bylaw which cannot be restricted to the area in which it was in force immediately before the union or which is not applicable to the county council’s circumstances shall be deemed inapplicable and revoked by the commencement of this order;
(5) Shall succeed to all rates and levies, and other money payable to the uniting authorities;
(6) Shall succeed to the valuation rolls, electoral rolls, and rate records in force in the districts of the uniting authorities, and these shall remain in force in the united county until such rolls or records are made by the county council and until that time Part IX of the Rating Act 1967 shall apply as if the united county was the district of a special purpose authority and the areas from which it was formed were constituent districts.
- Vesting of Property—(1) All property, real and personal, vested in the corporations of the districts of the uniting authorities is, subject to all existing encumbrances, hereby vested in the corporation of the county council.
(2) For the purposes of subclause (1) hereof any reference to the "Waitotara County Council" or "the Chairman, Councillors and Citizens of Waitotara County" or "the Chairman, Councillors and Citizens of Wanganui County" in any instrument or other document whatsoever, or in any entry or record made on any register in relation to any instrument or other document whatsoever shall, unless the context otherwise requires, be read as a reference to the "Wanganui County Council".
- Creditors—Subject to section 37f of the Local Government Act 1974, the rights or interests of creditors of any district affected by this order shall not be affected.
