Declaring Land and Easements Over Land Acquired for Post Office Purposes (Microwave Site) in Block III, Cromwell Survey District, Vincent County

PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby acquired for post office purposes (microwave site) and a right of way easement (to be held appurtenant to the land described in the First Schedule) over the land described in the Second Schedule hereto is hereby acquired, vesting in the Crown, its employees, agents and licensees, the rights relating to right of way easements set out in the Seventh Schedule to the Land Transfer Act 1952 and the cable easement described in the Third Schedule hereto is hereby acquired for post office purposes (microwave site) over the land described in the Fourth Schedule hereto; and that such land and easements shall vest in the Crown on the 4th day of February 1987.

THIRD SCHEDULE
OTAGO LAND DISTRICT
Description of Cable Easement to be Acquired

An easement for the transmission of telecommunication signals vesting in the Crown the full free, uninterrupted and unrestricted right, liberty, licence and authority in perpetuity at all times to transmit telecommunication signals by wires and cables over, along or beneath the surface of all that land described in the Fourth Schedule hereto and for that purpose to enter at all times and from time to time to lay, construct, place, reconstruct, inspect, repair, renew and maintain each line or lines of wires or cables over, along or beneath the surface of the land herein described (hereinafter called the ‘cable easement’).

The following conditions will apply to the cable easement:

(a) The Crown shall restore the surface of any land affected by the laying of cables and shall reinstate any fence removed to allow construction of the easement.

(b) Any future maintenance work will be discussed with the owner prior to execution.

(c) The cables shall be laid at a minimum depth of 1.2 metres and where the line runs through a stream, ditch or water race it may cross such by being attached to an iron rail.

(d) The Crown will provide and install marker posts to indicate the line of the cable easement on the ground.

(e) The owner, his agents and contractors will not be liable for any damage to the cables unless such damage is caused by the negligence of the owner, his agents or contractors.

Land Acquired for Road in Block XV, Waipukurau Survey District, Waipawa District

PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, the land described in the Schedule hereto is hereby acquired for road and shall vest in the Crown on the 4th day of February 1987, and pursuant to section 11 (1A) of the National Roads Act 1953 shall form part of State Highway No. 2.
