to do so immediately, it may be prepared to enter into negotiations
with Fifeshire for that purpose.
In deciding its future course the corporation may well take account
of the unusual delay in the tribunal completing this decision which
has given the corporation a continuation of its commercial radio
monopoly. The delay was not due to any such consideration but
the resulting windfall for the corporation may enable it to advance
the establishment of the FM Concert Programme.
We are sure the corporation will examine the situation positively.
Decision
The corporation’s ZM-FM application is declined. The Fifeshire
application is granted.
The following conditions will apply:
(1) The coverage objectives will be defined on the basis of the
technical evidence.
(2) The grant will lapse if not taken up within 12 months or such
further period as the tribunal may approve.
(3) The usual advertising condition.
(4) The maximum advertising per clock hour will be 8 minutes.
(5) The usual condition as to adherence to content and format.
(6) The usual condition as to technical standards.
(7) News media ownership will be limited to 30 percent.
(8) The tribunal will consent to R. Lucas & Sons Ltd.’s interest
of 40 percent (reducing to 37.5 percent if the options are
taken up) and Capital City Radio Ltd.’s interest of 14.9
percent for so long as:
1. Neither takes shares in the other either directly or
indirectly;
2. The ownership of either of those 2 companies does
not change to the extent that any shareholder which is a
news company (as will be defined in the warrant) gains a
prescribed interest in the warrant.
(9) The usual provision on networking.
(10) The transmitter will be co-sited with the television facility
at Grampian Hills.
(11) The warrant holder will take all steps necessary (including
any application to this tribunal) to establish a non-
commercial FM station at Grampian Hills for the sole
purpose of relaying the Concert Programme of Radio New
Zealand subject to the corporation indicating its willingness:
(a) to provide the programme at Grampian Hills;
(b) to allow co-siting at the expense of the warrant holder;
within a period of 3 years of the date of commencement
of broadcasting.
(12) The hours will be applied for. Within 3 years of commencing
broadcasting the hours will be increased from 19 to 24 in
week days.
(13) A deed of editorial independence from R Lucas & Sons Ltd.
in a form approved by the tribunal.
(14) The articles of association of the applicant will have to comply
with the tribunal’s requirements under the Broadcasting
Regulations. If any prospectus is issued any references to
the warrant or to the tribunal must first be approved by
the tribunal.
The corporation’s application to amend the 2YC-AM warrant is
granted on the following conditions:
(1) The grant will lapse if the relay station is not ready to broadcast
within 2 years of the date of this decision;
(2) The coverage objectives will be defined in accordance with
the technical information.
