Before the Indecent Publications Tribunal

In the matter of the Indecent Publications Act 1963, and in the matter of an application by David William Hewitt for the Tribunal to reconsider its previous decision classification and determination in respect of the following publication: Xaviera Supersex by Xaviera Hollander, published by Horwitz Publications, Hong Kong.

Chairman: Judge R. R. Kearney.

Members: Mrs H. B. Dick, Mrs R. Barrington, Mr A. J. Graham and Ms K. Hulme.

Hearing: At Wellington on 24 October 1986.

No Appearances.

DECISION

This publication was first submitted to the Tribunal for determination and classification in 1980 and on 11 March 1980 in a short decision which was set out hereunder in full, the Tribunal classified the book as indecent:

“This publication was imported commercially at Auckland in August 1979. Forfeiture is disputed by the importer Shop Six which has made written submissions.

The publication is reputed to be a book of sexual techniques designed to result in greater pleasure in sexual relationships. As well as advice on normal straight forward sexual techniques, this book describes and encourages matters of deviate sex, such as lesbianism, bondage and wife swapping.

Considerable doubt is raised with regard to the honesty of purpose of the authoress. The work, looked at as a whole, has little or no literary or artistic merit and is not redeemed by other characteristics. Whilst it is not as explicit as many books of similar type it is concerned solely with sex and with the more extreme sexual activities. There is little in the book to recommend it to the public good.

The Tribunal classifies this book as indecent.”

There have been a number of books on the subject of sexual intercourse and sexual techniques which have been classified as indecent except in the hands of particular classes of persons or as indecent in the hands of persons under a certain age. These classifications are granted to such publications because the Tribunal is satisfied in terms of section 11 of the Indecent Publications Act 1963 that they are serious productions produced with an honest purpose and in particular that they are books which although they display couples staged in acts of intercourse are carefully presented in a way that affords the least genitalia of offence and with little if any concentration on the amentia of males and females. The Tribunal is unanimous as was the Tribunal which in 1980 was required to consider the same publication in 1980 that this book has little if any honesty of purpose and certainly little if any literary or artistic merit nor do we find that the book is
