ORDER

  1. This order may be cited as the Glenbrook Peninsula Irrigation Order 1986.

  2. The Minister of Works and Development is hereby authorised to construct, maintain and control the water supply works described in the Second Schedule hereto to serve the district described in the First Schedule hereto.

  3. The area of land described in the First Schedule hereto is hereby constituted as an irrigation district to be known as the Glenbrook Peninsula Irrigation District (hereinafter referred to as “the District”).

  4. Water charges under Section 214 and 216 of the Act shall be payable over 20 years from the commencement of availability of supply of water and shall fall due for payment at the end of each irrigation season.

  5. The charges have been based on the recovery of 65 percent of the investigation costs, the estimated headworks and off-orchard costs plus interest, plus the full costs of operation, maintenance and the demand for water, as stated under sections 209 and 211 of the Act. As currently required an interest rate of 13.5 percent increasing to 15 percent in 3 years has been used. The charges shall be subject to adjustment; at the commencement of availability of supply; at the end of the fifth season of availability of supply and annually thereafter to compensate for any difference in any element of these charges as allowed for under sections 210 and 212 of the Act.

  6. Each land title within the District shall be subject to either an annual basic charge for each hectare of irrigable land included in the District, or a water availability charge.

  7. The annual basic charge payable in respect of irrigable land within the District shall be $885 per hectare and shall be payable where: (1) a water availability agreement has not been entered into, or (2) where charges under a water availability agreement would be less than the basic charge for the total specified irrigable area.

  8. The annual water availability charge payable in respect of water supplied shall be $1110 per unit. One unit being 3000 m³.

  9. Each land title within the District which is the subject of a water availability agreement will be allocated one unit of water for each hectare of irrigable land included in the District and will be liable for the annual charge of $1110 per unit whether or not the full 3000 cubic metres is used.

  10. The annual basic and water availability charges shall be reduced for the first four seasons of supply as shown in the Third Schedule hereto. The reductions, together with the interest thereon, shall be debited to the appropriate scheme account, and recovered over the subsequent 16 years.

  11. The irrigation season shall be that period commencing on the 1st day of June and ending on the 31st day of May next following.

  12. The minimum aggregate area of land occupied by any occupier that is to be included in the proposed irrigation district shall be one hectare (1.0 hectare).

  13. Surplus Water—If, at any time after the commencement of availability of supply, the National Water and Soil Conservation Authority is of the opinion that the supply of water from the water supply works is likely to be in excess of the amount to be supplied in accordance with water availability agreements, it may so advise the Minister and may recommend to him terms and conditions, being not more favourable than those applicable to water availability agreements, on which such surplus water should be supplied.

SECOND SCHEDULE

WATER SUPPLY WORKS

The Glenbrook Peninsula Irrigation Scheme headworks comprise firstly the groundwater bores and associated equipment located south of the peninsula and secondly the conveying waterworks to take water to the balance tank facilities (also headworks) located on high land to the south of the peninsula.

The off-orchard distribution works comprise the piped reticulation and associated works necessary to distribute irrigation water from the balance tank facility to the orchard boundaries. The said works include all pipes, valves, meters, fittings and all other works incidental to and required for the construction, maintenance and control of the said works for the scheme. The works constructed will have sufficient pipeline capacity to supply additional irrigable land should scheme extension be required. An off-take will be provided to each title in the District. The turnout valve and meter for which will form part of the distribution works.

The on-orchard works comprise the works necessary to distribute water from the orchard boundary as defined in individual orchard plans prepared for each property.
