  1. Subdivision and roading—(1) The County Council shall pay to the City Council not later than the 30th day of April 1986 any reserves contributions and any roading and other subdivision contributions received by it under the Local Government Act 1974 in respect of subdivision within the said areas and being unspent at that date.

(2) The City Council shall succeed to the assets and responsibilities covered by bonds made upon such subdivision.

  1. Assets and liabilities—(1) The sinking funds relating to those liabilities which pursuant to this order have become the liabilities of the City Council shall be transferred to the City Council.

(2) There shall be no apportionment of assets and liabilities, including loan liabilities, except as provided in this scheme or except for contingent or unknown liabilities, the apportionment of which shall be determined in accordance with the provision of section 37E and 37F of the Local Government Act 1974.

  1. Local Authorities Petroleum Tax—Pursuant to section 37G of the Local Government Act 1974, the Local Authorities Petroleum Tax received by the County Council in April and May 1986 shall be retained by the County Council and the Local Authorities Petroleum Tax received by the County Council in the remainder of the year ending 31 March 1987 shall be apportioned on the following bases:

The City Council shall receive four tenths;

The County Council shall receive six tenths;

or on such other basis as may be agreed to by the County Clerk of the County and the City Treasurer of the City Council.

AREAS EXCLUDED FROM COUNTY OF TARANAKI AND INCLUDED IN CITY OF NEW PLYMOUTH

PART I

ALL that area in the Taranaki Land District containing 122 hectares, more or less, bounded by a line commencing on the Tasman Sea coast at the westernmost point of Section 208, Omata District, and proceeding north-easterly along the mean high water mark of the sea to the middle of the Herekawe Stream; thence due south to that corner and south-westerly generally along the north-western boundary of Lot 1 aforesaid to the north-eastern corner of Te Ngahora Road; thence north-westerly and south-westerly along the north-eastern and south-western sides of the said road to Beach Road; thence north-westerly along the north-eastern side of Beach Road to the south-eastern boundary of Section 208, Omata District; thence south-westerly and north-westerly generally along the south-eastern and generally south-western boundaries of Section 208 aforesaid to the point of commencement.

ALSO all that area in the Taranaki Land District containing 3730 square metres, more or less, bounded by a line commencing at the easternmost corner of Lot 3, D.P. 10463 and proceeding north-easterly along a right line across Cowling Road to and again north-easterly along the north-western boundary of Lot 1, D.P. 10900 to and south-easterly along the north-eastern boundary of that lot to the northernmost corner of Lot 1 as shown on approved Scheme Plan No 1181 (Taranaki County Council No); thence south-easterly, south-westerly and north-westerly along the north-eastern, south-eastern and south-western boundaries of the said Lot 1 to the south-eastern boundary of Lot 1, D.P. 10900; thence south-westerly along the production of that boundary to the western side of Cowling Road; thence northerly generally along that roadside to the point of commencement.

PART IV

ALSO all that area in the Taranaki Land District containing 104 hectares, more or less, bounded by a line commencing at the north-western corner of part Section 54, Grey District, and proceeding north-easterly along the north-western boundaries of the said part Section 54 and part Section 55, Grey District, to a point 54.32 metres from the north-western corner of an unnamed legal Road; thence
