Pursuant to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, agreements to that effect having been entered into, the land described in the Schedule hereto is hereby acquired for soil conservation and river control purposes and shall vest in the Crown on the 5th day of June 1986.

Land and An Easement Over Land Acquired for a Block Valve Site in the County of Taranaki

Pursuant to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, the land described in the First Schedule hereto is hereby acquired, subject to the pipeline easement specified in easement certificate 303431, for a block valve site and vested in the Crown on the 5th day of June 1986, and further declares that the easement described in the Second Schedule hereto is hereby acquired for the said block valve site on the 5th day of June 1986 and shall be forever appurtenant to the land described in the First Schedule.

FIRST SCHEDULE

TARANAKI LAND DISTRICT

Land Acquired for Block Valve Site

All that piece of land containing 120 square metres, situated in Block X, Paritutu Survey District, being part Rekereke Block, marked "B" on S.O. Plan 12499, lodged in the office of the Chief Surveyor at New Plymouth.

SECOND SCHEDULE

TARANAKI LAND DISTRICT

Description of Right of Way

The full, free, uninterrupted and unrestricted right, liberty and privilege for the Crown (called "The Grantee") its servants, tenants, agents, workmen, licensees and invitees (in common with the registered proprietor of the said land (called "The Grantor")) its tenants and any other person lawfully entitled so to do) from time to time and at all times by day and by night to go, pass and repass by motor car and four wheel drive vehicles over the land described in the Third Schedule hereo (called "The Servient Tenement") upon and subject to the following conditions:

  1. The Grantor shall be entitled to erect such farm gates on the servient tenement as are necessary for the carrying on of its farming operations.

  2. The Grantee may use other types of vehicles only after approval of the Grantor has been obtained.

  3. The Grantee shall ensure that any gates on the servient tenement are closed after use and will make good any loss suffered by the Grantor through any failure to comply with this clause.

THIRD SCHEDULE

TARANAKI LAND DISTRICT

Land over Which Easement is Acquired

All that piece of land, situated in Block X, Paritutu Survey District, being part Rekereke Block; as shown marked "A" on S.O. Plan 12499, lodged in the office of the Chief Surveyor at New Plymouth.

Revoking a Declaration Acquiring Land and Right-of-Way Easement for a Sewage Pumping Station in the City of Manukau

Pursuant to section 55 of the Public Works Act 1981, the Minister of Works and Development hereby revokes the declaration dated 12 March 1986, declaring land and a right-of-way easement over land to be acquired for a sewage pumping station in the City of Manukau published in the Gazette of 20 March 1986, No. 40 at page 1200.

Pursuant to the Land Act 1948, and to a delegation from the Minister of Lands, the Assistant Director of Land Administration of the Department of Lands and Survey hereby sets apart the land described in the Schedule hereto, as a reserve for scenic purposes subject to the provisions of Section 19 (1) (a) of the Reserves Act 1977.
