The third category comprises 21 magazines all of which feature photographs of males indulging in homosexual activities. The Tribunal finds that none of these magazines have any merit; that they are all grossly indecent and injurious to the public good and are accordingly classified as indecent.

Before the Indecent Publications Tribunal

In the matter of the Indecent Publications Act 1963, and in the matter of an application by the Comptroller of Customs for a decision in respect of the following publications The Sex Manual’s Cookbook and Ann Summers’ Very Own Picture Book of Sexy Cocktails:

DECISION

These publications are sample copies imported through the port of Auckland in November 1985. The publications were seized and the importer has disputed forfeiture and as a result they have been referred to the Tribunal for classification prior to the commencement of condemnation proceedings pursuant to the Customs Act 1955. Written submissions were presented to the Tribunal on behalf of Waverley International Limited and these were read and considered by the Tribunal together with the submissions made on behalf of the Comptroller of Customs by Mr K. Wild.

These publications are basically recipe books one for food the other for cocktails. Each recipe has its own brief introduction and its own accompanying line drawing.

In the written submissions on behalf of Waverley International Limited it is advanced that the publications although not pretending to contain anything of social, artistic or literary importance are unlikely to corrupt an adult and call for an indecent classification.

In that regard the submission refers the Tribunal to its decision No. 621 in which it was held:

Although the double-talk in the recipes is sophisticating, sometimes amusing, and often coarse and vulgar, it is not in our judgment, likely to corrupt. The recipes themselves appear genuine and we see no grounds for restricting the availability of this book to mature readers. While it is not a book which one would deliberately wish to place in the hands of young adolescents, we cannot see it doing harm to those of an age to understand it.

The Tribunal finds that the line drawings are in many cases coarse and objectionable with in some cases the added negative feature of extreme bad taste. Despite those unsavoury features the Tribunal is satisfied that a restricted classification is all that is necessary and accordingly both publications are classified as indecent in the hands of persons under the age of 18.

P4/103 N.Z. Railways Corporation—Amend Passenger Transport Service Licence 2372 by adding a Special Condition—The licensee may vary the timetables on all routes subject to the following conditions:

(a) Reduction of service levels may not be made without agreement from the Regional or Local Authority with jurisdiction over the route concerned.

(b) In no circumstances can the seating capacity over the whole of the route in a 24 hour period be reduced by more than 25 percent in one or more service changes.

(c) The relevant Licensing Authority is to be advised of the changes and brief reasons for these no less than 7 days prior to implementation.

(d) The service changes shall be advertised in local papers at least 14 days before implementation, and details of the advertising supplied to the Authority in accordance with subclause (c).

R4/8 Leisure Rentals & Sales Ltd.—A new Rental Service Licence.

G4/89 Godfrey Holdings Ltd.—Amend Goods Transport Service Licence 14627 by adding a special condition to exempt 4 motor vehicles from section 109(1) Transport Act 1962 for the carriage of plyco products from Taupo to Tokoroa railhead for onward conveyance by rail.

G4/87 Craig Robert Littlejohn—Amend Goods Transport Service Licence 21578 by adding a Special Condition to exempt one truck and one trailer from section 109(1) Transport Act 1962 for the carriage throughout New Zealand of prefinished component parts of Lockwood Homes being carried under subcontract from Direct Transport Limited for delivery to building sites as required by Lockwood Buildings Limited or its franchised builders.
