Declaring Land in Otago Land District, Vested in the Otago Education Board as a Site for a School, to be Vested in Her Majesty the Queen

A PROCLAMATION

PURSUANT to subsection (6) of section 5 of the Education Lands Act 1949, I, The Most Reverend Sir Paul Alfred Reeves, the Governor-General of New Zealand, hereby proclaim and declare that the land described in the Schedule hereto, being an area vested in the Otago Education Board as a site for a school, shall be vested in Her Majesty the Queen, freed and discharged from every educational trust affecting the same, but subject to all leases, encumbrances, liens, or easements affecting the same at the date hereof.

SCHEDULE

OTAGO LAND DISTRICT—DUNEDIN CITY

1348 square metres, more or less, being Part Section 8, Block I, Andersons Bay Survey District. Shown marked “A” on S.O. Plan 21354. Part certificate of title 347/222 limited.

Declaring Land to be Crown Land

ORDER IN COUNCIL

At Wellington this 21st day of April 1986.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

WHEREAS by Deeds of Grant, dated the first and ninth days of June 1875, the lands described in the Schedule hereto, were granted to the Superintendent of the Province of Otago under the Public Reserves Acts 1854 and 1862 in trust for the establishment and maintenance of a University in the City of Dunedin in the Province of Otago, and of Public Schools in different parts of the Province and for the more general advancement of education in the said Province.

AND WHEREAS by section 9 of the Abolition of Provinces Act 1875, the said lands were vested in Her Majesty the Queen, in trust for the aforesaid purposes.

AND WHEREAS the said lands are not required for the purposes for which they are held.

NOW THEREFORE pursuant to section 15 (5) of the Education Lands Act 1949, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, hereby declares that the lands in the Schedule hereto shall, as from the date hereof, be Crown land subject to the Land Act 1948 freed and discharged from every educational trust affecting the same.

Authorising the Tauranga Harbour Bridge Committee to Reclaim Bay of Plenty Harbour Board Endowment and Crown Land from Tauranga Harbour

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL

PURSUANT to section 175 (3) and subject to sections 176 to 182 of the Harbours Act 1950, His Excellency the Governor-General, acting on the joint recommendation of the Minister of Transport and the Minister of Lands and by and with the advice and consent of the Executive Council hereby authorises the Tauranga Harbour Bridge Committee to reclaim an area of 9904 square metres of Tauranga Harbour Bed and Foreshore as shown on plan M.D. 16388 (S.O. 54097), deposited in the office of the Secretary for Transport at Wellington and as more particularly described in the Schedule below.

SCHEDULE

  1. All that parcel of land containing 85 square metres, more or less, situated in the Tauranga Survey District of the South Auckland Land District, being Crown Land and more particularly shown as part Bed Tauranga Harbour on plan M.D. 16388 (S.O. 54097), deposited in the office of the Secretary for Transport at Wellington.

  2. All that parcel of land containing 8113 square metres, more or less, situated in the Tauranga Survey District of the South Auckland Land District, being Crown Land and more particularly shown as part Bed Tauranga Harbour on plan M.D. 16388 (S.O. 54097), deposited in the office of the Secretary for Transport at Wellington.

  3. All that parcel of land containing 1706 square metres, more or less, situated in the Tauranga Survey District of the South Auckland Land District, being Bay of Plenty Harbour Board endowment and more particularly shown as foreshore on plan M.D. 16388 (S.O. 54097), deposited in the office of the Secretary for Transport at Wellington.
