  1. Any notice to be given to the Electrical Supply Authority shall be sufficient if sent by registered post letter to the offices of the Electrical Supply Authority.

  2. Any notice to be given on the part of the Minister of Energy shall be sufficient if given in writing signed by the Minister or by any person acting under the authority of the Minister.

  3. Any notice to be given to the Minister of Energy shall be sufficient if given in writing to or sent by registered post letter addressed to the Secretary of Energy, Ministry of Energy, Wellington.

  4. This licence shall not be construed as granting a consent to generate electricity pursuant to section 25 of the Electricity Act 1968.

  5. This licence shall come into force on the 1st day of April 1986 and shall continue in force for a period of 21 years from that date unless it is sooner lawfully determined in accordance with clauses 8 or 9 hereof.

  6. The Governor-General in Council may pursuant to section 22 of the Electricity Act 1968 cancel this licence if the Electrical Supply Authority is in breach of the provisions contained in clause 2 of these conditions.

  7. This licence may be cancelled by the Minister of Energy at the request of or with the consent of the Electrical Supply Authority.

  8. At the expiry or cancellation of this licence, the Electrical Supply Authority shall as required by notice in writing by the Minister of Energy remove all buildings, poles and other erections and all transmission lines, plant and other machinery and other removable equipment authorised by the licence to be erected, installed or provided and if within 12 months after being so required then the same shall, without payment of any compensation vest in and become the property of the Crown and it shall be lawful for any person authorised by the Minister of Energy in that behalf, subject to compliance with section 15A of the Electricity Act 1968 to enter upon any land or premises and take possession of and remove the same or any part thereof.

  9. Nothing contained in the licence, either expressly or by implication shall be deemed to authorise the Electrical Supply Authority to erect, construct or maintain any lines or works except subject to such conditions (not inconsistent with this licence) as may from time to time be lawfully imposed by any local authority within the district of which any such lines or works may be situated.

  10. The systems of supply shall be as described in paragraphs (a), (b), (d), (f) and (h) of Regulation 13 of the Electrical Supply Regulations 1984.

  11. The Electrical Supply Authority shall, 6 months prior to the expiry of the term of this licence provided in clause 7 hereof, make written application to the Minister of Energy for the granting of a new licence.

SCHEDULE

AREA OF SUPPLY

ALL that area in the Nelson Land District bounded by a line commencing at a point on the high-water mark on the north-western side of Rocks Road bearing 303° 42' from a point on the north-western side of Princes Drive, bearing 333° 26' 17" distance 16.73 metres from Standard Survey Mark CLXIV (S.O. 8460); thence south-easterly along a right line to the said point on the north-western side of Princes Drive; thence generally south-westerly along the north-western side of Princes Drive to the northmost corner of Lot 2, D.P. 5769, again south-westerly along the north-western boundary of said Lot 2 and the north-western side of Princes Drive to a point in line with the south-western side of Boundary Road; thence south-easterly to and along the south-western side of the said road and its production to the south-eastern side of Waimea Road; thence north-easterly along the south-eastern side of said road to the south-western side of said road to a point in line with the south-western boundary of Section D3, District of Wakatu; thence south-easterly to and along the south-western boundary of said Section D3 the south-western end of Tukuka Street, the south-western boundary of Section D21, District of Wakatu, the south-western end of Grampian Road and the south-western boundaries of Sections D28 and D29, District of Wakatu to the northmost corner of Section 7, District of Brook Street and Matai; thence south-westerly along the north-western boundaries of the said Section 7 and Sections 8, 10 and 3 of 8 District of Brook Street and Matai to the westmost corner of the said Section 3 of 8; thence south-easterly along the south-western boundary of said Section 3 of 8 and that boundary produced to a point in line with the south-eastern boundary of Section 35, District of Brook Street and Matai to the eastmost corner of the said Section 35; thence north-westerly along the north-eastern boundary of the said Section 35 to the southernmost corner of Section 36, District of Brook Street and Matai; thence north-easterly, north-westerly, south-westerly and again north-westerly along the south-eastern, north-eastern, north-western and north-eastern boundaries of Section 21, District of Brook Street and Matai to the north-eastern boundary of Section 44, District of Brook Street and Matai to the northernmost corner of said Section 44; thence north-westerly, north-easterly and again north-westerly along the north-eastern, south-eastern and north-eastern boundaries of the aforesaid Section 36 and Section 1, District of Brook Street and Matai to the south-eastern boundary of Section B21 and Sections B20 and B19, District of Wakatu; thence north-easterly along the south-eastern boundaries of the said Section B21 and Sections B20 and B19, District of Wakatu to the north-eastern boundary of Section B11 and B10, District of Wakatu to the eastern boundary of the said Section B10 and Sections B9 and B8, District of Wakatu, the last-mentioned boundary produced across Nile Street East and Section B7, District of Wakatu to the north-eastern corner of said Section B7; thence westerly and northerly along the northern and eastern boundaries of said Section B7 and the eastern boundary of said Section B7 produced to the left bank of the Matai River; thence generally easterly, northerly and southerly along the said left bank to a point in line with the north-eastern boundary of Section A8, District of Wakatu; thence north-westerly and westerly to and along the north-eastern and northern boundaries of said Section A8 to the north-western corner of the said Section A8; thence westerly and southerly along the northern and western boundaries of Section A7, District of Wakatu; thence westerly along the north-eastern boundary of Section A4 and Section A10, District of Wakatu to the south-eastern corner of Section 1166, City of Nelson; thence northerly along the eastern boundary of the said Section 1166 to the easternmost corner of Section A9, District of Wakatu; thence westerly along the northern boundary of the said Section A9 to the south-eastern corner of Section A1, District of Wakatu; thence northerly and westerly along the eastern and northern boundaries of said Section A1 to the south-eastern corner of Section 1204, City of Nelson; thence northerly along the eastern boundaries of said Section 1204 and Section 1203, City of Nelson to the north-eastern corner of the said Section 1203; thence easterly, northerly and westerly along the southern, eastern and northern boundaries of Section 270A, City of Nelson to a point in line with the south-eastern boundary of Section 269A, City of Nelson; thence north-easterly across the end of Cambria Street to and along the south-eastern boundary of the said Section 269A to the easternmost corner of said Section 269A; thence north-westerly along the north-eastern boundary of the said Section 269A and that boundary produced across Atawhai Drive and along the north-eastern side of North Road; thence westerly across North Road to and along the northern boundary of the said Section H9 to the easternmost corner of Section 1167, City of Nelson; thence north-westerly along the north-eastern boundary of the said Section 1167 to its northernmost point; thence north-westerly along a line being the north-westerly production of the south-western boundary of Lot 3, D.P. 3202; thence north-westerly along the said north-westerly production of the south-western boundary of Lot 3, D.P. 3202 to the high-water mark of the western side of the Boulder Bank; thence generally south-westerly along the said high-water mark, across the entrance to the Port of Nelson and the high-water mark of the western side of Haulashore Island to its southernmost point; thence south-easterly along a right line to the point of commencement.

The said area being more particularly shown outlined in black on plan NZE 2119 (sheets 1 to 19) deposited in the office of the Electricity Division of the Ministry of Energy at Wellington.
