Declaring Land to be Acquired for Road and a Batter Easement (in Gross) to be Acquired for Road Purposes in Block X, Port Nicholson Survey District, City of Wellington

PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into:

(a) The land described in the First Schedule hereto, to be acquired for road and vest in the Wellington City Council.

(b) A batter easement (in gross) over the land described in the Second Schedule hereto is hereby acquired for road purposes and shall vest in the Wellington City Council and shall confer upon the said Council, the full and free rights, liberties, licences and privileges hereinafter set forth in the Third Schedule hereto on the 16th day of January 1986.

Batter Easement

AN easement in gross vesting full and free right, liberty and licence at all times for the Wellington City Council, its servants agents and workmen to enter upon and create and maintain batters as part of the formation of Happy Valley and Ohiro Roads on the parcels of land described in the Second Schedule hereto together with full and free right liberty and licence for the Council its servants and agents and workmen at all times to enter upon and occupy the said parcels of land for the purpose of carrying any works repairs replacements or excavations or constructions where the same or any of them may in the opinion of the Wellington City Council be necessary to ensure the safety or full use and enjoyment of the said formation as road.
