Compliance with a declared standard shall not preclude the need to comply with the Electric Wiring Regulations 1976. This list supersedes all notifications of declared specifications previously published in the New Zealand Gazette.

Before the Broadcasting Tribunal

In the matter of the Broadcasting Act 1976, and in the matter of applications by HAURAKI ENTERPRISES LIMITED and BRIERLEY INVESTMENTS LIMITED for consent to hold prescribed interests in two AM warrants in Auckland:

DECISION

The applicants sought the Tribunal's consent pursuant to regulation 20 (4) (b) of the Broadcasting Regulations 1977 to Hauraki Enterprises Ltd. (Hauraki) and Brierley Investments Ltd. (BIL) having prescribed interests in the radio warrants for Radio Hauraki (1XA) and Radio I (1XI).

Hauraki is the holder of the warrant for Radio Hauraki and Radio I Holdings Ltd. is the owner of Radio I Ltd., holder of the warrant for Radio I.

Before the matters arose which led to the application, Radio Hauraki held 24.9 percent shareholding in Radio I Holdings Ltd. but this was not a prescribed interest because at the time it was acquired the Broadcasting Regulations provided that the entitlement to exercise a voting power of 25 percent or less of the total voting powers of the company did not of itself constitute a prescribed interest.

The Broadcasting Regulations 1977, Amendment No. 5 (S.R. 1981/295) changed the trigger point for a prescribed interest from 25 percent to 15 percent but in regulation 12 (S.R. 1981/295) saved Radio Hauraki's interest in Radio I.

The Broadcasting Regulations 1977 as amended by Broadcasting Regulations Amendment 1977, Amendment No. 7 (S.R. 1985/197):
“20. General restrictions on interests in sound-radio warrants and sound-radio programme warrants—(1) This regulation applies to—
(a) Every sound-radio warrant held in respect of a private broadcasting station; and
