Manukau City Boundary Alteration Notice 1986

PURSUANT to section 50 (2) (b) of the Local Government Act 1974, the Minister of Local Government gives the following notice:

NOTICE

  1. This notice may be cited as the Manukau City Boundary Alteration Notice 1986.

  2. This notice shall come into effect the day after its publication in the Gazette.

  3. The boundaries of Manukau City are hereby altered by including within the said City the areas of land described in the Schedule hereto, being land reclaimed from the sea.

SCHEDULE

864 square metres, more or less, being Lot 1, D.P. 97518, situated in Block III, Otahuhu Survey District. Part certificate of title 55B/958.

484 square metres, more or less, being Lot 2, D.P. 97518, situated in Block III Otahuhu Survey District.

Commerce Act 1975

NOTICE is hereby given of Decision No. 153 of the Commerce Commission dated 13 February 1986. By this decision which relates to a collective pricing application made by the Electronic and Appliance Servicing Federation of New Zealand (Inc.) the commission resolved to approve the issue by the federation to its members of a charge-out rate formula for home appliance servicing repair and maintenance work subject to the condition that the formula be issued substantially in the form annexed to the decision.

The full text of this decision is available for inspection or purchase from the commission whose address is Sixth Floor, 163 The Terrace, Wellington (P.O. Box 10-273).

Declaration of Vehicle with Motorcycle Controls to be a Motorcycle

PURSUANT to section 2 (1) of the Transport Act 1962, and pursuant to an instrument of delegation dated 28 March 1985, the Chief Controller, Land Transport Policy, hereby declares that the vehicle described in the Schedule hereto is a motorcycle for the purposes of the said Act.

The three-wheeled vehicle with motorcycle controls and a 1200 cc Volkswagen engine bearing the number 5019924 assembled in 1985 by Phillip Brett Emmett of Tauranga.

Before the Broadcasting Tribunal

IN the matter of the Broadcasting Act 1976, and in the matter of applications for short term broadcasting authorisations by:

(1) AUCKLAND UNIVERSITY STUDENTS ASSOCIATION (INC.) (BRO. 89/85);

(2) VICTORIA UNIVERSITY OF WELLINGTON STUDENTS ASSOCIATION INC. (BRO. 126/85);

(3) MASSEY UNIVERSITY STUDENTS ASSOCIATION INC. (BRO. 128/85);

(4) WAIKATO STUDENTS UNION INC. (BRO. 123/85).

DECISION

(1) Auckland University Students Association Inc.

The applicant seeks a series of authorisations to permit broadcasting from Sunday, 16 February 1986 to Sunday, 7 December 1986 daily from 7 a.m. to 1 a.m. on weekdays and continuously in weekends.

In the previous year the station had broadcast for a similar period but terminated its weekday morning transmissions at 10 a.m. on weekdays and resumed at 4 p.m. There were also periods during the year when it broadcast right through the day.

The application is otherwise similar to the previous year and attracted support from several private commercial stations in Auckland but drew opposition from the Broadcasting Corporation. On 17 October the Corporation wrote:

"The Corporation objects to and opposes this short-term application.

"1. From its beginning as a part time station to cater for students' needs during term times, the Auckland University Students station now has the aspect of a full time warrant without the obligation (incumbent on all other full time operations in Auckland) to justify itself in an open Tribunal hearing. With respect, this makes a mockery of the Tribunal system.

"2. Some of the advertising revenue of $70,000 would have to be advertising pool money which would normally accrue to the young adult station, 1ZM. That advertising pool is limited, and the warrant condition under which 1ZM operates requires a 24 hour operation for 365 days of the year. That operation is open to regular review before the Tribunal.

"3. In section 3.1 of this application, 50 percent of the purposes of the station are purely concerned with alternative radio. Only 1 of the 8 purposes is specifically student orientated.

"The Corporation submits that if the student station is not to have a full (Tribunal) hearing the following restrictions should apply:

(a) The station be restricted to broadcasting during weekdays only in term time, and

(b) Advertising be restricted only to a proportion of the broadcast day."

The applicant was informed of these objections and responded to them, making the following points:

  1. The applicant has expanded with increased staff resources and expertise over 11 years in steady natural growth but was not ready for full time broadcasting because of limited income and the use of voluntary services of students.

  2. Although 1ZM's ratings have dropped, the applicant's ratings have not correspondingly increased. The advertisers use the station because no other station attempts to appeal specifically to students and other young people interested in student activities and alternative entertainment.

  3. The objectives have been virtually unchanged for the past 5 years.
