Memorandum of Variation of Heads of Agreement Re Transfer of Public Reserve Land in Rotorua District, to Local Authority Control

Parties: Minister of Tourism, Hon. M. K. Moore; Minister of Lands, Hon. K. T. Wetere; Mayor of Rotorua on behalf of the Rotorua District Council, J. E. Keaney.

MEMORANDUM of variation made this 3rd day of October 1986 of memorandum of Heads of Agreement dated the 31st day of May 1983 between:

(i) The Minister of Tourism

(ii) The Minister of Lands

(iii) The Rotorua District Council (hereinafter called “the parties”)

whereas

(a) By a memorandum of Heads of Agreement dated the 31st day of May 1983 (hereinafter called “the said memorandum”) as subsequently varied and recorded in the New Zealand Gazette, 1984, No. 125, page 2770, the parties jointly and severally agreed (inter alia) that the land known as the Sanatorium Reserve and as more particularly described therein (hereinafter called “the said land”) should be removed from the control of the Minister of Tourism and vested in the Rotorua District Council upon the conditions contained therein:

(b) By clause 10 of the said memorandum it was agreed that the Minister of Tourism would continue to provide for the maintenance of that area of the said land which is known as the Government Gardens until and including the 31st day of March 1987 and upon and subject to the conditions referred to in such clause 10:

(c) Other arrangements for the maintenance of the Government Gardens have since been negotiated between the Rotorua District Council and the New Zealand Tourist and Publicity Department and the maintenance provisions in the said clause 10 are no longer appropriate:

(d) In consequence of the aforesaid arrangements the parties are desirous of varying the said memorandum

Now this memorandum of variation witnesseth that the parties do jointly and severally agree that by deletion of clause 10 thereof relating to the area of the said land known as the Government Gardens the said memorandum is hereby varied.

Save as hereinbefore expressly varied the said memorandum shall remain in full force and effect.

In witness whereof this agreement has been entered into on the date first hereinbefore written.
