Neither the granting of the consent nor anything in the consent expressly or by implication contained shall affect or prejudice any liability imposed by law on the grantee to pay compensation or damages to any person arising by reason of the exercise by the grantee of the powers conferred by the consent.

The rights granted by the consent shall be subject to all existing rights thereforefore granted and validly held and enjoyed under any enactment or otherwise.

If at any time during the continuance of the consent the grantee fails or neglects to observe, perform, and comply with any of the provisions in the consent expressly or by implication contained, or otherwise makes default in complying with the terms of the consent, then the Minister may forthwith by notice in writing to the grantee revoke and determine the consent.

The grantee of this consent must give notice as hereinafter provided to the Minister of Energy of any change of address of the grantee, or of the registered office, or usual place of business of the grantee.

Any notice to be given to the grantee shall be sufficient if—
(a) Served personally on the grantee or (in the case of the grantee being a corporate body) delivered at the registered office or usual place of business of the grantee to a person appearing to have for the time being the control of such premises; or
(b) Sent by registered post letter addressed to the grantee at the postal address set out in the application for a consent or any subsequent address notified by the grantee to the Minister.(b) Any notice to be given on the part of the Minister shall be sufficient if given in writing signed by the Minister or by any person purporting to act on behalf of or under the authority of the Minister.
(c) Any notice to be given to the Minister shall be sufficient if given in writing delivered to or sent by registered post letter addressed to the Deputy Secretary, Ministry of Energy, Electricity Division, Private Bag, Wellington.

Headworks consisting of a dam and intake situated in Section 1, Block IX, Gore Survey District.

Pipeline leading to the powerhouse giving a static head of approximately 75 metres.

Tailrace from the powerhouse to the sea.
The said works are as shown on the plan marked NZE 816 deposited in the office of the Electricity Division, Ministry of Energy at Wellington.

Notice of Marine Mammal Permit Application
(Notice No. 3677, Ag. 9/6/1b/1)
PURSUANT to section 5 (5) of the Marine Mammals Protection Act 1978, the Minister of Fisheries advises that David Blair, senior lecturer in zoology at the University of Canterbury, has applied for a permit to import and possess one consignment of tissue samples from marine mammals for research. Further details of this proposal may be obtained from the Director, Fisheries Management Division, Ministry of Agriculture and Fisheries, Private Bag, Wellington.
Any person or organisation wishing to make representations relating to this application must forward their representation in writing to me within 28 days of publication of this notice.

Notice Changing Name of Porirua Community College and Altering Constitution 1986
PURSUANT to section 69 of the Education Act 1964, the Minister of Education gives the following notice:
NOTICE
-
(a) This notice may be cited as the Porirua Community College change of name to Porirua Community College and alteration of constitution notice.
(b) This notice shall come into force on the date of its publication in the Gazette.

The name of the Porirua Community College constituted by notice published in the New Zealand Gazette on 8 August 1985, is hereby varied to Porirua Community College.

Clause 4 (i) of the principal notice is hereby amended by deleting the phrase "the Gold Coast Promotion Council (Inc.)" which appears in the fourth line and substituting the phrase:
"the Kapiti Coast Promotion Council (Inc.)".

Clause 4 (1) of the principal notice is hereby amended by deleting the phrase "the Porirua Business Development Council" which appears in the second line and substituting the phrase:
"the Porirua Business Development Council (Inc.)".

Notice Declaring Fishery Management Areas
(Ag. 9/2/2; No. 3669)
- Pursuant to section 5 of the Fisheries Act 1983, I hereby declare the areas described in the Schedule to this notice to be fishery management areas for the management of all species of fish within those areas:
Provided that this notice shall not apply to—
(i) Any fish taken by foreign fishing craft pursuant to the Territorial Sea and Exclusive Economic Zone Act 1977 and any regulations made thereunder;
(ii) Barracouta (Thyrsites atun), Hake (Merluccius australis), Hoki (Macruronus novaezelandiae), Ling (Genypterus blacodes), Orange Roughy (Hoplostethus atlanticus), Oreo Dory (Allocyttus spp.), Pseudocyttus maculatus, Neocyttus rhomboidalis), Silver Warehou (Seriolella punctata) and Squid (arrow squid, Nototodarus sloanii, broad squid, Sepioteuthis bilineata);
(iii) Albacore Tuna (Thunnus alalunga), Bigeye Tuna (Thunnus obesus), Skipjack Tuna (Katsuwonus pelamis), Slender Tuna (Allothunnus fallai), Southern Bluefin Tuna (Thunnus maccoyii) and Yellowfin Tuna (Thunnus albacares).

The notice published in the Gazette on 27 April 1984, No. 68, page 1402, declaring Fishery Management Areas, is hereby revoked.

This notice shall come into force on the 6th day of February 1986.
SCHEDULE
Kermadec Fishery Management Area
ALL that area of New Zealand fisheries waters around the Kermadec Islands enclosed by a line commencing at a point 34°34.3'S and 179°51.0'W on the outer limits of the exclusive economic zone; and then proceeding generally in an easterly, northerly, westerly and southerly direction along the outer limits of the exclusive economic zone to a point 34°22.1'S and 179°29.6'E on the outer limits of the exclusive economic zone; and then proceeding in a straight line to the first-mentioned point.
Auckland Fishery Management Area
ALL that area of New Zealand fisheries waters enclosed by a line commencing at Tirua Point on the west coast of the North Island (at 38°23'S and 174°38.5'E); and then proceeding along a straight line to the outer limits of the exclusive economic zone to a point 37°35'S and 170°03'E; then proceeding in a generally northerly and easterly direction along the outer limits of the exclusive economic zone to a point 33°25'S and 177°59.4'E; then proceeding due south to Cape Runaways on the east coast of the North Island (at 37°32'S and 178°02'E); and then in a generally north-westerly and south-westerly direction along the line of the mean high-water mark of the coast of the North Island to the point of commencement.
Central Fishery Management Area
ALL that area of New Zealand fisheries waters enclosed by a line commencing at Cape Runaways on the east coast of the North Island (at 37°32'S and 178°02'E); then proceeding due north to a point at 35°25'S and 178°02'E; then proceeding in a generally south-westerly direction along the outer limits of the exclusive economic zone to its intersection with the 42°10'S parallel of latitude; then proceeding due west along latitude 42°10'S to a point 167°20'E; then proceeding in a straight line to a point 43°32'S and 174°20'E; then proceeding in a straight line to a point on the outer limits of the exclusive economic zone at 37°44'S and 169°56'E; then proceeding in a generally northerly direction along the outer limits of the exclusive economic zone to a point 37°35'S and 170°03'E; then in a straight line to Tirua Point on the west coast of the North Island (at 38°23'S and 174°38.5'E), then proceeding in a generally north-westerly and south-westerly direction along the line of the mean high-water mark of the coast of the North Island to the point of commencement.
