  1. Use of nets—Subject to clause 5 (2) of this notice no licence holder shall use or cause to be used for taking any acclimatised fish, a net of any description:

Provided that it shall be a defence for any person charged with a breach of this clause if he proves that he was netting for indigenous fish in accordance with the provisions of any regulations or notices in force in that behalf.

  1. Prohibition on possession or control of spear gun—(1) No licence holder shall, when taking any acclimatised fish or when in possession of any acclimatised fish, use or have in his possession or under his control any spear gun or any pointed missile (other than a bullet) which is propelled by means of any mechanical or explosive device.

(2) Where any person is charged with an offence under subclause (1) of this clause, it shall be a defence to the charge if the defendant proves that the spear gun or pointed missile in his possession or under his control was not used in taking the acclimatised fish.

(3) In this clause the term “explosive” has the same meaning as in the Explosives Act 1957.

  1. Authorised lures and baits—No licence holder shall fish for acclimatised fish with any bait or lure other than artificial or natural fly, insect, worm, crustacea, minnow, fish (excluding fish ova or any portion of a fish or any shellfish (mollusca)), or uncoloured bread dough.

  2. Daily limit bag—(1) No licence holder shall on any one day take or have in his possession more than 10 trout or salmon.

(2) Notwithstanding subclause (1) of this clause no licence holder shall on any one day take or have in his possession more than four—

(a) salmon;

(b) trout taken from the Pomahaka River upstream from Switzer’s Bridge.

(3) No licence holder shall continue to use a rod and running line to take trout or salmon on any day on which he has already taken or killed 10 trout or salmon.

(4) It shall be permissible to make up the difference between a lesser limit bag prescribed in one place and a higher limit bag prescribed in another place.

  1. Minimum size to be taken—(1) No licence holder shall take or have in his possession, any trout or salmon which does not exceed in length:

(a) In the case of any trout or salmon taken from the Water of Leith or the Teviot River, 20 cm;

(b) In the case of any trout or salmon taken from any other water, 25 cm.

(2) Every licence holder taking a trout or salmon which does not exceed the specified length shall immediately return it with as little injury as possible into the water from which it was taken.

  1. Revocation—The notice published in the supplement to the Gazette, No. 165 of Thursday, 5 September 1985, on pages 3898–3899, titled District Anglers (Otago Acclimatisation District) Notice 1985, is hereby revoked.

District Anglers (North Canterbury Acclimatisation District) Notice 1986

PURSUANT to section 71 of the Fisheries Act 1983, the North Canterbury Acclimatisation Society hereby gives the following District Anglers Notice.

NOTICE

  1. Title and commencement—This notice may be cited as the District Anglers (North Canterbury Acclimatisation District) Notice 1986, and shall come into force on the 1st day of October 1986.

  2. Interpretation—(1) Words and expressions in this notice which are defined in the Fisheries Act 1983 or the Freshwater Fisheries Regulations shall have the meanings so defined.

(2) In this notice the term “high country waters” means Lakes Lilian, Coleridge, Selfe, Evelyn, Grace, Henrietta, Ida, Little Ida, Catherine (also known as Monk), Georgina, Spectacles, Red Lakes, Lyndon Tarn, Lyndon, Rubicon, Pearson, Grasmere, Sarah, Hawdon, Marymere, Vagabonds Inn Tarn, Blackwater, Letitia, Minchin, Sheppard, Taylor, Katrine, Sumner, Mason, Guyon, and Tennyson, and all waters flowing into those lakes; and includes all other lakes and tarns lying west of a line joining—

(a) The white posts at the Lake Coleridge powerhouse on the Rakaia River; and

(b) The white posts at Woodstock on the Waimakariri River; and

(c) The junction of the Hurunui River with the South Branch; and

(d) The junction of the Waiau and Hope Rivers; and (e) The New Zealand Electricity Department’s bridge over the Clarence River approximately 2.5 km downstream from Lake Tennyson.

  1. Open season—(1) Subject to subclauses (2) and (3) of this clause and to clause 4 of this notice there shall be an open season for fishing for acclimatised fish from the 1st day of October in any year to the 30th day of April in the following year (both days inclusive).

(2) There shall be an open season for fishing for acclimatised fish from the first Saturday after Queen’s Birthday Weekend to the 31st day of August in the same year (both days inclusive) in the following waters:

(i) The Waiau River downstream from its junction with the Hope River:

(ii) The Hurunui River downstream from its junction with the South Branch:

(iii) The Ashley River downstream from the Ashley Gorge Road Bridge approximately 0.5 km below the Domain:

(iv) The Waimakariri River downstream from the white posts at Woodstock:

(v) The Selwyn River downstream from where the south Springston Road meets that river:

(vi) Lake Forsyth, and the Wairewa and Okuti Rivers downstream from the road bridge over each river on the Little River - Te Oka Bay road:

(vii) Lakes Taylor, Sumner, Coleridge, Lyndon, and Selfe, except within 200 m of any stream flowing into those lakes:

(viii) The Rakaia River downstream from the bridge on the main South Road.

(3) There shall be an open season for fishing for acclimatised fish from the 1st day of October in any year to the 30th day of September in the following year (both days inclusive) in the Heathcote River, and the Avon River except as provided in clause 4 (1) (c) of this notice.

(4) No licence holder shall fish for or take any acclimatised fish except during an open season.

  1. Closed season—(1) There shall be a closed season for fishing for acclimatised fish—

(a) From the 1st day of October in any year and ending with the Friday immediately preceding the first Saturday in November in the same year (both days inclusive) in any high country waters:

(b) From the 1st day of March to the 30th day of April in the same year (both days inclusive) in the Rakaia River and its tributaries above the Lake Coleridge powerhouse, that point being more particularly shown by white posts on the river banks or in any tributary flowing into Lake Coleridge, whether artificial or natural:

Provided that this paragraph shall not apply to any lakes draining into the Rakaia River above the point specified:

(c) From the 1st day of October in any year to the 30th day of September in the following year (both days inclusive) in Taylor’s Drain from its source to its junction with the Wairarapa Stream, in the Avon River from the Armagh Street Bridge at Hagley Park to the Barbadoes Street Bridge, in the canal commonly called the Wilberforce Diversion which connects Lake Coleridge with the Wilberforce River, and in Lake Marion.

(2) There shall be a closed season for fishing for quinnat salmon from the 1st day of March to the 30th day of April in the same year (both days inclusive) in the following waters:

(a) The Clarence River above the New Zealand Electricity Department’s bridge approximately 2.5 km below Lake Tennyson, or any tributary of that part of the river:

(b) The Hurunui River above the junction of the South Branch with that river, or any tributary of that part of that river, including Lake Sumner:

(c) The Waiau River above the junction of that river with the Hope River, or any tributary of that part of the Waiau River:

(d) The Waimakariri River above the white posts at Woodstock, or any tributary of that part of that river or the Kowhai River and its tributaries.

  1. Authorised tackle—(1) No licence holder shall fish for or take any acclimatised fish except by using a rod and running line.
