The Rural Fire Districts Revision Order 1986

ORDER IN COUNCIL

At Wellington this 23rd day of June 1986

Present:
THE RIGHT HON G. W. R. PALMER PRESIDING IN COUNCIL

Pursuant to the Forest and Rural Fires Act 1977, His Excellency the Governor-General, acting by and with the advice of the Executive Council, hereby makes the following Order.

(1) This Order may be cited as the Rural Fire Districts Revision Order 1986.

(2) This order shall come into force on the 1st day of July 1986.

(1) The Order constituting the Hutt Rural Fire District made on the 24th day of November 1948 (a) (hereinafter in this clause, together with all amendments thereto, referred to as the principal Order) is hereby amended by revoking, wherever they occur, the words “the Wellington City and Suburban Water-supply Board” and substituting the words “the Wellington Regional Council”.

(2) The principal order is hereby amended by revoking, wherever they occur, the words “Hutt Rural Fire District” and substituting the words “Wellington Regional Council Rural Fire District”.

(3) This clause shall be read together with and be deemed part of the principal Order.

(1) The Order constituting the Waiheke Rural Fire District made on the 22nd day of November 1950 (b) (hereinafter in this clause, together with all amendments thereto, referred to as the principal Order) is hereby amended by revoking, wherever they occur, the words “the Waiheke Road Board” and substituting the words “the Waiheke County Council”.

(2) This clause shall be read together with and be deemed part of the principal Order.

(1) The Order constituting the Waipori Rural Fire District made on the 14th day of November 1977 (c) (hereinafter in this clause, together with all amendments thereto, referred to as the principal Order) is hereby amended by revoking the word “Corporation” in clause 6 thereof and substituting the word “Council”.

(2) This clause shall be read together with and be deemed part of the principal Order.

(1) The Order constituting the Marlborough North Rural Fire District made on the 29th day of October 1979 (d) (hereinafter, in this clause referred to as the principal Order) is hereby amended by adding to the end of clause 6 thereof the words “, from its inception the said committee to be known as the Marlborough North Rural Fire Committee”.

(2) This clause shall be read together with and be deemed part of the principal Order.

Every description, in any Order in Council listed in the First Schedule hereto, of property or in the nature of the property for the protection of which the district is constituted or is in existence, for the purposes of section 5 of the Forest and Rural Fires Act 1955 (repealed by section 70 of the Forest Rural Fires Act 1977) is hereby revoked.
Every reference, in any Order in Council listed in the First Schedule hereto, to a “closed season” or “closed fire season” shall be read as a reference to a “restricted season” or “restricted fire season” as defined by section 2 of the Forest and Rural Fires Act 1977.
The Orders in Council set out in the Second Schedule hereto (which list outdated delineations of the Fire Districts named in the Schedule) are hereby revoked.
