Declaring Land to be Crown Land in the City of Wellington
PURSUANT to section 42 of the Public Works Act 1981, the Minister of Works and Development declares the land described in the Schedule hereto to be Crown land subject to the Land Act 1948, and subject to the right of way created by Transfers Nos. 22348, 26011 and 55283.

Leasehold Estate and Cable Easement, in Gross, Over a Leasehold Estate Acquired for Defence Purposes in Waitemata City
PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, the leasehold estate in the land described in the First Schedule hereto, and a cable easement, in gross, over the leasehold estate described in the Second Schedule hereto, subject to the conditions contained in the Third Schedule hereto is hereby acquired for defence purposes and shall vest in the Crown on the 17th day of January 1985.

THIRD SCHEDULE
NORTH AUCKLAND LAND DISTRICT

The Lessee agrees to the Crown entering upon the land together with all requisite machinery and conveyances for the purpose of laying, inspecting, maintaining, repairing and renewing the electric cable or cables and light standards through, along and under that portion of the land described in the Second Schedule hereto.

The Crown shall have the right to erect and maintain such fixtures as may be necessary to indicate the location of the said cable.

Any damage to the property or to growing crops done by the Crown its agents or workmen during entry for the laying, inspecting, maintaining, repairing or renewing the said cable and light standards or erecting and maintaining any fixtures shall be made good at the expense of the Crown and the property restored as reasonably practicable to the condition existing before entry or alternatively the Crown at its option may compensate the Lessee for any damage, loss of crops, etc.

The cable is buried at a depth of 1 metre below the surface of the land.

The surface soil of the easement may be worked to a depth of 0.5 metres but if the Lessee desires to lower the ground contour or work the soil to a greater depth he shall before commencing any such work notify the Resident Engineer, Ministry of Works and Development at Takapuna of his intention to perform such work.

The Lessee will not erect or permit to be erected any building structure or plant or permit to be planted any trees on the land covered by the easement.

The boundaries of the easement shall not be fenced.
