Notice is hereby given that a petition for the winding up of the above-named company by the High Court was, on the 24th day of October 1985, presented to the High Court by MODEL MERCHANT LIMITED, a duly incorporated company having its registered office at Wellington, suppliers of wood and model parts; and that the said petition is directed to be heard before the Court sitting at Auckland on the 4th day of December 1985 at 10 o’clock in the forenoon; and any creditor or contributory of the said company desirous to support or oppose the making of an order on the said petition may appear at the time of hearing in person or by his counsel for that purpose; and a copy of the petition will be furnished by the undersigned to any creditor or contributory of the said company requiring a copy on payment of the regulated charge for the same.

Upon reading the notice of motion for order for stay of winding up order and affidavits of John Marson Franich, Raymond Gordon Burgess, Jane Lisa Prever and Brian Leonard Marks and the further affidavit of John Marson Franich, sworn and filed herein and upon hearing P. J. Wright of counsel for the applicant, and G. Wardell of counsel for the first respondent, and J. N. T. Wells of counsel for the second respondent, this Court hereby orders that all proceedings in relation to the order to wind up Intra Partners New Zealand Limited, made by Henry J., pursuant to the Companies Act 1955 on the 16th day of October 1985, at the petition of National Can (N.Z.) Limited, M. No. 1016/85, be stayed, and further orders that the official assignee as provisional liquidator take no further proceedings in relation to the said order to wind up Intra Partners New Zealand Limited.
