Before the Indecent Publications Tribunal
IN the matter of the Indecent Publications Act 1963, and in the matter of an application by the Comptroller of Customs for a decision in respect of the following publications: The Pop Up Kama Sutra, published by Aidan Ellis Publishing Ltd., England.

DECISION
This publication was imported as a sample copy as it was the intention to import commercial quantities. The importer referred the publication to the comptroller who now asks for a classification.
The publication consists of 4 pop up drawings and has 2 pages of text which bear no relation to the pictures. It is a tawdry publication but selling at $14.85 could not be considered cheap. Burton’s Kama Sutra is available in public libraries so that there is no need for this type of book.
This is not the first occasion upon which the Tribunal has been asked to classify publications claiming in one form or another to be the Kama Sutra (decisions 308, 863 and 985). In decision 863 it was said that the Kama Sutra itself is not indecent although it has not been classified by the Tribunal. Burton’s translations of the Kama Sutra and the Perfumed Garden are recognised as classic works. What we are asked to consider on this occasion and have been asked to consider on earlier occasions are imitations. They are not the Kama Sutra nor do they resemble the Kama Sutra in any way. Clearly the purpose is dishonest. This publication is classified as indecent.

DECISION
These 2 books were part of a commercial shipment imported through Auckland. The Tribunal was not told how they came to be imported but it is assumed that they were referred to avoid forfeiture.
Both books are written anonymously. It was suggested that they were written by the same author who wrote Him, Them, Us, Me and Two which received an age classification. We would doubt this because the style is different and the language less subtle. In many respects they resemble the books we considered in Decision 1083 but it can be said that they are better produced. Nevertheless each publication deals with the sexual exploits of the principal character in a variety of ways. The descriptions are explicit. Neither has any literary or artistic merit, and each is injurious to the public good. Each is classified as unconditionally indecent.
