But subsection (3) of section 95A provides that nothing in section 95 (1) (a) applies in respect of an alleged failure to comply with the obligation imposed by section 24 (1) (a)—the provision of a range of programmes which will cater in a balanced way for the varied interests of different sections of the community.

That paragraph exactly describes the complaint which Mr Simpson made. Indeed Mr Simpson specifically made the complaint because of that provision. He agreed, when it was pointed out to him, that it was not a provision about which a formal complaint could be lodged. He then endeavoured to bring the complaint within the general standard suggesting that the disproportionate amount of rugby broadcasting was a breach of the standards which are generally acceptable in the community.

This cannot be done. The substance of the complaint is one which the Act specifically provides may not be dealt with as part of the complaints procedure.

To do so would create another body (ultimately the Broadcasting Tribunal by reference) which would be responsible for the programming of the stations. The corporation clearly has that responsibility and can deal with informal complaints, objections or preferences that Mr Simpson might lodge with it.

But the formal complaints procedure is not available to him.

There is therefore no complaint which the corporation need have considered under the Act. That being the case there is no basis for referring the complaint to the Broadcasting Tribunal.

The Tribunal therefore will not determine the complaint. It has no power to do so.

LPG Fuel System Approvals

Pursuant to regulation 90B of the Traffic Regulations 1976* (as inserted by the Traffic Regulations 1976, Amendment No. 7) and pursuant to the powers delegated to me by the Secretary for Transport, I, Robert Norman Abram, chief automotive engineer, hereby approve the components listed in the Schedule hereto for inclusion in any LPG fuel system installed and operated in accordance with the requirements of New Zealand Standard NZS 5422: Part 1: 1980 (and any standard made in amendment thereto or in substitution therefor).

Notice of Intention to Vary Hours of Sale of Liquor at Licensed Premises—Hawke’s Bay Licensing Committee

Pursuant to section 221A (1) of the Sale of Liquor Act 1962 as amended by section 22 (1) of the Sale of Liquor Amendment Act 1976, I, Stanley James Callahan, Secretary for Justice, hereby give notice that the Hawke’s Bay Licensing Committee on 27 September 1985 made an order authorising variations of the usual hours of trading for the licensed premises known as the Hotel Central, Napier.

To the intent that on days other than those on which licensed premises are required to be closed for the sale of liquor to the general public, the hours for the opening and closing of the said premises shall be as follows:

(a) On any Friday and Saturday—Opening at 11 o’clock in the morning and closing at 11 o’clock in the evening.

(b) On any New Year’s Eve—Opening at 11 o’clock in the morning and closing at 00.30 o’clock in the morning of New Year’s Day.
