DECISION

All of these publications were commercially imported through the port of Dunedin. The importer, acting responsibly, requested the Comptroller of Customs to refer the publications to the Tribunal for classification.

The Comptroller of Customs was the only person represented at the hearing and a submission was presented on his behalf by K. W. Wild. As indicated there was no representation on behalf of the importer nor were there any submissions tendered on its behalf.

The Boudoir is claimed to be a reprint of a Victorian periodical of the same name and is a collection of stories, poems and miscellaneous items. A great deal of the material contained in this publication is of a most explicit and coarse sexual nature. The book appears to the Tribunal to be a device for describing a number of sexual episodes of a kind which are portrayed clearly indecent.

Aphro-Dizzia, Crimson Hairs, Oh Wicked Country and The Crusader Books I to IV are all similar in that they are dominated by vividly descriptive sexual episodes. None of the books in our view can claim to have any literary merit and we agree with the submission made by Mr Wild on behalf of the Comptroller of Customs that they have weak story lines and little to commend them. These books are clearly in the view of the Tribunal indecent.

The Sign of the Scorpion is, in our view, on a somewhat higher literary plane than the books referred to in the previous paragraph but like them it too has a dominant theme of explicitly descriptive sexual activities. We agree with the Comptroller of Customs who through Mr Wild has submitted that the predominant theme of the book written in a graphically descriptive way is such to outweigh any of the book's redeeming features and again in the Tribunal's view is clearly indecent.

Birch in the Boudoir although described as a Victorian novel is, according to its introduction, a collection of intimate letters said to have been published in France in 1905. Whether the origins are indeed genuinely Parisian of 1905 is a matter about which we remain unashamed but in any event the letters are in each case graphic descriptions of different sexual encounters and the whole publication is in our view clearly indecent.

Lady Beth and Clara Birch are again novels purportedly penned in the Victorian era of anonymous writers. The authenticity of the Victorian claim is something which the Tribunal doubts but again in any event they are novels which feature long and numerous descriptions of sexual activity. The Tribunal finds that these two publications are indecent.

Jennie is again claimed to be a Victorian novel of anonymous authorship and its authenticity of such is likewise doubted by the Tribunal. It too in any event is a book which is totally dominated by vivid descriptions of a woman's sexual adventures, has in the Tribunal's view little literary merit and is clearly indecent.

The final publication in respect of this application is The Woman Thing written by Harriet Daimler. Unlike most of the other books considered in this particular application it is of modern origin. The book, although slightly better written than most of the others considered in this decision, is nevertheless one of little if any literary merit being most explicit in describing sexual encounters and containing a number of descriptions of violent sexual episodes. In the view of the Tribunal this book too is clearly indecent.
