Revoking a Notice Declaring Stopped Road to be Disposed of in
Block X, Tadmor Survey District, Waimea County
Pursuant to section 55 of the Public Works Act 1981, the Minister
of Works and Development hereby revokes the notice dated the
10th day of December 1984 and published in the New Zealand
Gazette of 13 December 1984, No. 232 at page 5665, declaring
stopped road to be disposed of in Block X, Tadmor Survey District,
Waimea County.

Declaring Road in Strathallan County to be Stopped
Pursuant to section 116 of the Public Works Act 1981, the Minister
of Works and Development declares the portion of road described
in the Schedule hereto to be stopped.
SCHEDULE
CANTERBURY LAND DISTRICT
All that portion of road containing 252 square metres (10 perches),
situated in Block XIV, Geraldine Survey District, adjoining or
passing through part Rural Section 11475; as shown coloured green
on S.O. Plan 11497, lodged in the office of the Chief Surveyor at
Christchurch.

Declaring Land to be Acquired for Road in Strathallan County
Pursuant to section 20 of the Public Works Act 1981, the Minister
of Works and Development declares that, an agreement to that effect
having been entered into, the land described in the Schedule hereto
is hereby acquired for road and shall vest in The Strathallan County
Council on the 22nd day of August 1985.

Pursuant to section 20 of the Public Works Act 1981, the Minister
of Works and Development declares the land described in the Schedule hereto to be acquired for waterworks, and shall vest in
The Wanganui County Council on the 22nd day of August 1985.

WELLINGTON LAND DISTRICT
All that piece of land containing 116 square metres, situated in
Block II, Ikitara Survey District, being Section 549, left bank
Wanganui River. All Gazette notice 824529 (New Zealand Gazette

Declaring an Easement in Gross to Support a Retaining Wall
Acquired for the Auckland - Hamilton Motorway in the City of
Auckland
Pursuant to section 20 of the Public Works Act 1981, the Minister
of Works and Development declares that, an agreement to that effect
having been entered into, an easement in gross to support a retaining
wall (existing as at 5 July 1985) is hereby acquired over the land
described in the First Schedule hereto vesting in the Crown the
rights, and imposing on the registered proprietor of the land the
obligations set out in the Second Schedule hereto for the Auckland -
Hamilton Motorway and shall vest in the Crown on the 22nd day
of August 1985.
FIRST SCHEDULE
NORTH AUCKLAND LAND DISTRICT
Easement to Support a Retaining Wall—Servient Tenement
All that piece of land situated in the City of Auckland being part
Lot 1, D.P. 65143; as shown marked “E” on S.O. Plan 52532, lodged
in the office of the Chief Surveyor at Auckland.
SECOND SCHEDULE
NORTH AUCKLAND LAND DISTRICT
Rights and Obligations Under Easement to Support Retaining
Wall
-
The Crown together with its agents, servants, workmen and
employees may enter upon the servient land at all times and generally
to do and perform all such acts and things as may be necessary or
convenient for the full and proper exercise and enjoyment of the
rights and privileges hereby granted but in such exercise the Crown
shall carry out the works with all possible expedition with the least
interference possible to the registered proprietor’s occupation and
use of the land. -
The registered proprietor shall not at any time do or suffer any
act or thing which will affect or damage the anchorage system or
prevent or interfere with the full and free use and enjoyment by
the Crown of the rights and privileges created in this declaration
and in particular not to increase the ground loading beyond those
existing as at 5 July 1985 nor to carry out any excavation or to
construct any piles or foundations exceeding one (1) metre in depth
below the existing ground level without first obtaining the written
permission of the District Commissioner of Works and Development
at Auckland. -
For the purpose of paragraph 2 of this Schedule “ground
loadings” shall mean the weight of any buildings or structures
existing at the said time together with the weight of any vehicles,
plant or other matter or thing deposited on the surface of the servient
land by the registered proprietor or the registered proprietors
licensees, servants, agents and employees in the course of the
registered proprietors usual business activities.
