ORDER
- Title and commencement—(1) This order may be cited as the Murupara Borough - Whakatane District Boundaries Alteration Order 1985.
(2) This order shall come into force on the 1st day of July 1985.
- Boundaries of Murupara Borough and Whakatane District altered—The boundaries of Murupara Borough and Whakatane District are hereby altered by:
(a) Excluding from Whakatane District and including in Murupara Borough the area described in the First Schedule to this order; and
(b) Excluding from Murupara Borough and including in Whakatane District the area described in the Second Schedule to this order.

Effect on wards—The area referred to in clause 2 (b) of this order, shall form part of the Galatea Ward in Whakatane District.

Transfer of powers, functions and other responsibilities—The Murupara Borough Council, in respect of the area referred to in clause 2 (a) of this order, and the Whakatane District Council, in respect of the area referred to in clause 2 (b) of this order:
(a) Shall have and may exercise and be responsible for all the powers, duties, acts of authority, and functions which were previously exercised, or which would have been so exercised, by the territorial authority from whose district the area is hereby excluded;
(b) Shall have and may exercise and be responsible for all liabilities, obligations, engagements, and contracts which previously were, or which would have been, the responsibility of the territorial authority from whose district the area is hereby excluded;
(c) Shall have and may exercise and be responsible for all actions, suits, and proceedings pending by or against, or which would have been the responsibility of the territorial authority from whose district the area is hereby excluded;
(d) Shall succeed to the bylaws which are in force and which are applicable to the authority's altered circumstances and, until revoked or altered by such authority, every such bylaw shall remain in force in the area in which it was in force immediately before the alteration of boundaries; and every bylaw which cannot be restricted to the area shall be deemed inapplicable and revoked in respect of the area by the alteration of boundaries;
(e) Shall succeed to all rates or levies and other money payable to the territorial local authority from whose district the area is hereby excluded; and
(f) Shall succeed to the valuation rolls, electoral rolls, and rate records in force in the area, and these shall remain in force until such rolls or records are made for it and until that time Part IX of the Rating Act 1967 shall apply as if the district in which that area is included was the district of a special purpose authority and the areas from which it was formed were constituent districts.

Vesting of land—The corporation of Murupara Borough in respect of the area referred to in clause 2 (a) of this order, and the corporation of Whakatane District in respect of the area referred to in clause 2 (b) of this order, shall have vested in it, subject to all existing encumbrances, all land in the area vested in the corporation of the district of the local authority from the district of which the area is excluded.

Mayors and Principal Administrative Officers—The mayor and principal administrative officer of the Murupara Borough Council shall exercise the duties, powers, and functions of the mayor and principal administrative officer of the Whakatane District Council in respect of the area referred to in clause 2 (a) of this order, and the mayor and principal administrative officer of the Whakatane District Council shall exercise the duties, powers and functions of the mayor and principal administrative officer of the Murupara Borough Council in respect of the area referred to in clause 2 (b) of this order.

Creditors—Subject to section 37F of the Local Government Act 1974, the rights or interests of creditors of any district affected by the order shall not be affected.

Rating—The system of rating in the areas referred to in clause 2 (a) and 2 (b) of this order shall continue to be the land value system.

Apportionment of assets and liabilities—There shall be no apportionment of assets and liabilities, including loan liabilities.
FIRST SCHEDULE
Area Included in Murupara Borough
All that area in the South Auckland Land District, containing 380 hectares, more or less, bounded by a line commencing in the middle of the Pokairoa Road in Block XIII, Galatea Survey District, at a point in line with the northern boundary of Karatia 3B2A2B1 and proceeding south-westerly along the middle of Pokairoa Road to the middle of No. 38 State Highway; thence south-easterly along the middle of that highway to a point 94 metres north-west of the left bank of the Rangitaiki River; thence along right lines bearing 159°08', distance 263 metres, 205°00', 45.13 metres, 233°15', 72.42 metres, 208°15', 193.12 metres, 195°3', 193.12 metres, 210°00', 120.70 metres, 135°00', 329.92 metres, 97°45', 120.70 metres and 241°30' to the middle of Kiorenu Road; thence northerly and easterly along the middle of Kiorenu Road and Railway Road to a point in line with the southern boundary of part Karatia 3B1C; thence easterly to and along that boundary as shown on ML 11986, crossing the intervening Pokairoa Road and its production to the middle of the Rangitaiki River; thence generally northerly down the middle of that river to the middle of the Whirinaki River; thence generally southerly up the middle of that river to a point in line with the north-western boundary of Whirinaki 1, Section 2B; thence southerly to and along the last mentioned boundary as shown on ML 10446 to the south-eastern corner of part Whirinaki 1, Section 2H2; thence generally north-westerly along the generally south-western boundaries of the last mentioned section, to the eastern boundary of part Whirinaki 1, Section 2K; thence northerly along the eastern boundary of the last mentioned section to the north-western boundary of that section crossing an intervening roadline; thence westerly along the north-western boundary of the last mentioned section and again westerly by a right line in line with the southern boundary of Section 212, S.O. 47262, to its intersection with the middle of Ngatimanawa Road; thence northerly along the middle of Ngatimanawa Road and its production to and along the eastern boundary of Lot 1, D.P. S. 7081 and its production to the middle of the Rangitaiki River; thence generally northerly down the middle of that river to a point in line with the northern boundary of Karatia 3B2A2B1; thence westerly to and along that boundary to the point of commencement.
SECOND SCHEDULE
Area Included in Whakatane District
All that area in the South Auckland Land District, containing 23.04 hectares, more or less, bounded by a line commencing at the intersection of the western side of No. 38 State Highway in Block XIII, Galatea Survey District, and the north-western boundary of Lot 4, D.P. S. 28038 and proceeding south-westerly along that last mentioned boundary to a point in line with the south-western boundary of part Lot 1, D.P. S. 30931; thence north-westerly to and along that boundary and the south-western boundaries of Lots 2 and 3, D.P. S. 30931 and Lots 1, 2, 3, D.P. S. 24816, to a point in line with the south-eastern boundary of Lot 9, D.P. S. 11090; thence north-easterly to and along that boundary and northerly along the eastern boundaries of the last-mentioned lot to and south-easterly along the southern boundaries of Lots 3, 4, 5, 6, 7, 8, D.P. S. 11090 and northerly along the eastern boundary of Lot 8, D.P. S. 11090, to the southern side of No. 38 State Highway; thence generally south-easterly along that side to the point of commencement.
