Commerce Act 1975
NOTICE is hereby given that by letter dated 17 May 1984, the
Minister of Trade and Industry has required the Commerce
Commission, in terms of subsection 7 of section 82 of the Commerce
Act, to inquire into and report to him on the advisability of removing
cement, manufactured in New Zealand, when sold by the
manufacturer, from the Positive List of Controlled Goods and
Services.
The Minister has referred this matter to the Commission to
consider in the context of its consideration of the applications lodged
by two New Zealand cement manufacturers seeking approval to
a proposed Collection Pricing Agreement and a proposed
Individual Resale Price Maintenance Arrangement.
Copies of the full text of the Minister’s letter are available on
request from the Commission’s offices.
The Commission proposes to hold a public inquiry into this matter
commencing at 10 a.m. on Wednesday, 22 August and continuing
on 23 and 24 August. If necessary, the inquiry would reconvene on
Tuesday, 28 August and then continue until concluded. This inquiry
will be held at the Commission’s offices, Sixth Floor, 163 The
Terrace, Wellington.
Persons or organisations who may wish to take part in this inquiry
are asked to notify the Commission’s Executive Officer of this fact
in writing by Friday, 22 June 1984, the date on which party
registrations will close. It would assist the Commission if parties
would indicate at that time their general attitude towards the issues
which are the subject of the inquiry.
A background paper from the Secretary of Trade and Industry is
being obtained in relation to the question of Positive List price
control. This would be circulated on 29 June 1984 for the assistance
of parties. A report from the Examiner of the Commercial Practices
relating to the applications for approval of the Collective Pricing
Agreement and the Individual Resale Price Maintenance
Arrangement will be forwarded to parties on 13 July 1984.
Submissions from all parties are required to be filed with the
Commission by Tuesday, 7 August 1984. These will be circularised
