Declaring Road to be Stopped in the County of Manawatu
Pursuant to sections 116 and 117 of the Public Works Act 1981, the Minister of Works and Development declares the portions of road described in the Schedule hereto to be stopped, and declares that:
(a) The area marked "B1" shall be amalgamated with the land in certificate of title, Volume 595, folio 210, subject to memorandum of mortgage No. 419178.1.
(b) The area marked "C" shall be amalgamated with the land in certificate of title, Volume 595, folio 18, subject to memorandum of mortgage No. 397484.2.

Declaring a Right of Way Easement, and Easement to Support a Retaining Wall Acquired for the Auckland Hamilton Motorway in the City of Auckland
Pursuant to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, a right of way easement in gross, vesting in the Crown the rights contained in paragraph 1 of the Seventh Schedule to the Land Transfer Act 1952 is hereby acquired over the land described in the First Schedule hereto for the Auckland-Hamilton Motorway, and also declares that an easement to support a retaining wall (existing as at 19 February 1982) appurtenant to the land described in the Second Schedule hereto, vesting in the Crown the rights and imposing on the registered proprietor of the land the obligations set out in the Fourth Schedule hereto, is hereby acquired over the land described in the Third Schedule hereto, for the Auckland-Hamilton Motorway and shall vest in the Crown on the 29th day of March 1984.

FOURTH SCHEDULE
North Auckland Land District
Rights and Obligations Under Easement to Support Retaining Wall

The Crown together with its agents, servants, workmen, and employees may enter upon the servient land at all times and generally do and perform all such acts and things as may be necessary or convenient for the maintenance of the integrity of the wall and anchorage system for the life of the wall.

The registered proprietor shall not at any time do or suffer any act or thing which will affect or damage the anchorage system of the wall or prevent or interfere with the full and free use and enjoyment by the Crown of the rights and privileges created by this declaration and in particular shall not increase the ground loadings beyond those existing as at 19 February 1982 and shall not carry out any excavation or construct any piles or foundations exceeding 1 metre in depth below the ground level as at 19 February 1982 without first obtaining the written permission of the District Commissioner of Works at Auckland.

For the purpose of paragraph 2 of this Schedule "ground loadings" shall mean "the weight of any buildings or structures existing at the said time together with the weight of any vehicles, plant or matter or thing deposited on the surface of the servient land by the registered proprietor or the registered proprietor's licensees, servants and agents and employees in the course of the registered proprietor's usual business activities."
