Declaring Drainage and Sewage Easements to be Acquired for Teachers’ Residences in Blocks VIII and IX, Waipu Survey District, Otamatea County

PURSUANT to section 20 of the Public Works Act 1981, the Minister of Works and Development declares that, an agreement to that effect having been entered into, a drainage easement over the land described in the First Schedule hereto vesting in the Crown the rights and powers contained in paragraphs 3 and 5 of the Seventh Schedule to the Land Transfer Act 1952, and a sewage easement over land described in the Second Schedule hereto vesting in the Crown the rights and powers contained in paragraphs 4 and 5 of the Seventh Schedule to the Land Transfer Act 1952, together with the additional rights and conditions contained in the Third Schedule hereto, such easements to be held appurtenant to the land described in the Fourth Schedule hereto, are hereby acquired for teachers’ residences, and shall vest in the Crown on the 15th day of March 1984.

THIRD SCHEDULE

NORTH AUCKLAND LAND DISTRICT

Additional Rights and Conditions to Which the Sewage Easement is Subject

THAT the registered proprietor of the land (called “the grantor”) shall have the right during the continuance of the easement to connect to the line of drainage pipes a subsidiary line of drainage pipes for the purpose of draining and discharging water from the grantor’s residence and also to connect to the line of sewage pipes a subsidiary line of sewage pipes for the purpose of draining, discharging or conveying sewage and other waste material and fluid from the grantor’s residence, the location of such connections and subsidiary pipelines to be agreed upon by the grantor and the Crown.

That the costs of inspecting, servicing, maintaining, and renewing the drainage and sewage pipelines shall be shared by the grantor and the Crown on the basis that the grantor shall pay one-fifth (1/5th) of such costs and the Crown shall pay four-fifths (4/5ths) of such costs.
